its easy to say what the legal terms of legislation are but to a consumer it isnt the same thing. to us a charge is a charge. the law needs to get upto date and wake up to modern usage of words such as charge. if statutes cant be dealt with by normal people were is justice. back with the rich and privalidged. its the 21st century we all enter into contracts how are we to do so if we have no idea what the terms are unless we can afford lawyers to save us from ourselves.

If people are struggling with banks taking their money from benefits, then there is the First Right of Appropriation which you can use. You need to write to them 7 days before your money is due to go into your account, and you need to list the essential bills you need to pay (ESSENTIAL - mortgage/rent/council tax/secured loan/food/heating/water) with the money and ask that you can exewrt your First right of appropriation on the money. Also state what money is due in, when, and when and how you will withdraw it.(will probably need to be over the counter)
Some banks will and some banks won't but it does work sometimes - councils recommend using this right (which is common law) to stop banks eating housing allowance and housing benefit payments in between in entering your bank account and leaving to pay the landlord.
Not sure if theres much about it on here. It won't help you reclaim past charges, but if you are terrified that you will have no money left in a couple weeks because the charges will swallow your benefits, try it.
Then get your benefits out and paid into a Post Office Card Account and protect them from charges. You can always move them over the next day to pay DD's etc but at least then you have control.LegalBeagles0 -

So some banks are making refunds to certain people and some banks aren't??
My wife and I are on benefits and unfortunately because of bank charges we have got behind with our rent, council tax, utilities and are finding it hard to manage the charges, as stated earlier, what takes the banks seconds to charge takes me upto 2 months to sort out, this includes taking money from other budgets like food!!
Our landlord has now served us a notice to vacate the premises due to the arrears and are having to move back in with my mother, 1 bed flat, as an interim, so thats my mum, my wife, me and our daughter living in a 1 bed flat.
This has all come down to the bank charges, depending on the charges we sometimes take longer than 2 months to get sorted because the bank takes "their" money first, then there isn't enough to cover the DD's etc. so they charge us again.
This, in my opinion, is disgraceful and very unfair!
My letter to claim the charges back was sent 6 days ago so waiting to hear back, now the Supreme court has decided against the ruling I feel that I will never see this money again so would like to claim via First Right of Appropriation if there is no offer from this claim.
Bit of a rant I know I just think its disgusting that £2.6bn of the banks profits, which i believe to be over a third of all their profits, is made by taking money from their customers accounts, the funniest thing is that Natwest charge £38.00 per D/D that doesn't go out, my smallest D/D is £11.73, so surely it would be easier to pay the direct debit then charge me, I don't even have an overdraft fercility, so technically I shouldn't even go overdrawn but the bank allows me to so they can charge.
Its a farce, very unfair and I am going to cancel all my D/D and pay the bills when they come!!
BANKS ARE NOT CUSTOMER FOCUSED, THEY ONLY FOCUS ON MAKING SHARE HOLDERS HAPPY AND RICH!!0
