    apparently,

    "section 187 of the Social Security Administration Act 1992, under Section 45 of the Tax Credits Act 2002 is an identical provision to the said section 187 of the 1992 Act"
    prohibits the banks from debiting these charges from benefits, confirmed by the test case:
    Woods v Royal Bank of Scotland 1913 SLT 1 Reports 499.
    Eligible Benefits:
    tax credits, paid to my client by HM Inland Revenue, and/or child benefit paid by DWP, and/or child maintenance from the CSA, and/or social security benefits - income support, Jobseeker’s Allowance, Incapacity Benefit, Disability Living Allowance, Attendance Allowance etc., - paid by DWP

  • Hi can you tell me whether you can reclaim charges if you have gone bankrupt or are in an financial arrangement?
  • I am confused. I have received documentation of the last 6yrs bank charges, but need to clairify that for a period of this time I was on Incapacity benefit, does this mean I should get charges relevant to this period back immediately? I can't find anything that states what benefits are counted within the Social Security Administration Act 1992? Prior to going on to Incapacity benefit I was on SSP, this this also count?

    Can anybody help?
  • I have quoted this Act in relation to my claim but the bank have responded by saying that they and their legal advisers believe that debiting these bank charges to an account into which benefis have been or will be paid is not contrary to the provisions of that Act.

    I'm disabled, my sole source of income is benefits, and I'm about to apply to have bank charges overturned, so an answer to this question would be very useful for me too.

    Hi guys ive just been in contact with my bank natwest over a bounced dd that happend this week whilst i was laid up in bed with bloodclots to my lungs so i have been in a pretty bad way.

    Anyway to cut a long story short i phoned the to say i couldnt pay the charge as i was only on benefits they refunded half the charges to me but i also found out some interesting info that you can go to your bank and ask them for your benefit (e.g) JSA,IB,etc and they will give them to you they have an obligation to give you your benefit regaurdless if you owe the bank money they override the system in bank to pay you your benefit so if you incure a charge go into your local branch and ask them for your benefit they have to give it to you.

    I have been charged £20 by TSB, for going overdrawn by 38p.
    I have never been overdrawn with them, in the 6 or so years I have banked with them.
    I am now on income support, sadly, isn't there a rule that they can't take money from you, if benefits are your only income.
    Could i ask on the phone for a refund of the charge or do I have to put it in writing.
    Thanks for any help.

    Yes you should phone them first and try to get a refund this way as if it's a first offence they are normally understanding. Also if you are on benefits I believe this falls under financial hardship and the waiver does not include these cases. Good luck!

    I rang up the same day i noticed i was overdrawn, I transfered money staright over but found out the next day I was 38p short
