We had a flight delay of nearly 10 hours with Thomson airways, the flight was December 2014, this was an outbound flight and so delayed the start of our holiday,I wrote to Thomson requesting compensation, I have only just received a letter from them rejecting my claim, there reason: extraordinary circumstances due to bird damage, so they are stating this is the reason for the delay.
Yes we were originally removed from the aircraft due to them finding bird damage to the wing of the flight, but our original flight time was 9 45 a.m., we were told that another flight would be sent to replace the damaged plane, we were told that we should then be boarding no later than 2 pm, this was not the case, we were continually trying to get information from the information desk as to why the delay was extended, we were told that they waiting on another crew to arrive, if this is the case, then surely the bird damage is not the reason for that amount of delay.
Please can someone advice as to what claim if any I have on this.
