Ins claim still against me and I wasn't driving!

In 2010 I was insuring a car for my then hubby, he had left at this point and was on hol with his girlfriend!. He rear ended someone and conciquently a claim was made on the ins.
I was with the AA at the time and spoke to them saying I was not the driver of the car and they were going to rectify this and change the details on the claim.:mad:
I presumed this was sorted and have had ins since with another company, yes it's never been particularly cheap, but I put this down to the growing price in vehicle ins as compared to some of my friends it was on par.
I have just changed companies and received the proof of no claims and to my annoyance it's listed the afore mentioned accident and listed me as the driver!!.
Is this correct?, at the time I had 2 insurances, 1 for my car and another for hubby's as his quotes were too high!.
Is there anything I can do to rectify this or someone I can contact to have this removed as this accident was nothing to do with me!?

    If you were the policyholder then the claim will have been made on your policy so you will have to declare it, whether or not you were the driver.

    The good news is that no insurer requires you to declare accidents or claims for more than 5 years, and some (Admiral and Direct Line spring to mind) only only ask about accidents and claims in the last three years, so if the accident was in 2010 its effect on your premium should be reduced now if you shop around, and it will have no effect at all next year.
  • It's extremely annoying when it's effected me for these years and he was the driver, never mind the fact he wasn't even with me at the time!... This along ŵith the constant ad hock sales calls for accident claims!!.... My opinion is that even if it was my ins andit was his car and he was the named driver, HE should bethe one that's named as from what he says it's never effected his ins at all!

    Sounds like your husband was the main driver and you took out the policy in your name to save on the insurance costs. If so, this is 'fronting' and is insurance fraud so the consequences could have been a lot worse.

    Your husband does have to disclose this claim to any insurer that covers him (as a policyholder or named driver).


    Everyone is entitled to their own opinion regarding anything.


    But as far as the circumstances you describe go, the claim is correctly one you have to disclose.

    He was the main driver yes and I to,d the AA that at the time and the fact it was his car but was still given ins regardless.
    Had I of known it was illegal I wouldn't of ins it.

    As far as his divulging the accident to any ins companies , I thought there was a database to refer to whilst making quotes and would presume it would of been registered on there.... I'm wondering if with me named as driver that in fact his name was not used in any of the claim!

    The question you're asked when you take out a policy is (something like) "have you had any accidents, claims or incidents in the last x years". You've had a claim so you have to declare it. Meanwhile he's had an accident so he should be declaring it as well - and that will likely have an effect on his premium too. Of course he might choose not to declare it, in which case he'll get cheaper quotes, but also a good chance of having his cover voided if he actually has to make another claim.
  • My ins company I hve at the moment informed me I had claimed before I had the chance!.... I don't have a problem paying whatever is due it just frustrates me when I seem to have been penalised because of someone elses mistake..... I guess that's life and you live and learn, unfortunately it makes you think twice about helping anyone else no matter what the circumstances are.
    Insurances seem to have their own set of rules with regards to claims, it is apparent that those whose name shows at the top get the consequences even with no attachment to th claim with regards to blame.

    There's the Claims and Underwriting Exchange, but insurers often check it when you actually make a claim rather than at inception - which means you can often get away with not declaring an accident until you actually need to make a claim.

    Or it may be that the details are recorded incorrectly and his name doesn't appear - in which case he's had a lucky break.

    If being recorded as the driver rather than just the policyholder has led to you paying more for your cover over the last few years you might have grounds for a complaint against the insurer that made the mistake. You could get an idea of whether it has by doing some dummy quotes on a price comparison site - one with you as the driver, another with you just as the policyholder - and seeing if there's a difference in the quotes you get. If the price comparison sites' questions don't differentiate between an accident as driver or as policyholder (I haven't checked whether they do) then you can probably assume it makes no difference.

    Well.....you were the one who chose to add him onto your own policy, and seemingly were happy to let this continue (continuing to let him drive on your policy and risking your NCD) even after he went off with another woman!
