Car accident liability

  • was the other vehicle already passing the parked cars before you got to where the parked cars were?

Your witnesses need to confirm if you stopped or not when hit as well as the business with the lights.

But if the witnesses confirm the other party was already driving past the parked vehicles before you have got to the parked vehicles, then it won't help you and this will end up a 50/50 at best.
  • I did stop, he complained thst i had stoped in the middle of the road the road so it was my fault.

The front drivers side wheel is broken and facing in the Wrong direction

The only comments I got from the witnesses was that it wasn't right and they couldn't understand why he was blinding me with his lights.... This was pretty much all I gdt plus their details to follow up.

How have you managed to do that if they were pointing straight ahead?

If offered two choices of crashing into kerb or car I think I'd choose kerb, of course watching for pedestrians. Did this happen during dark as you say you were dazzled by his lights?

Saying that, if someone's forcing you to damage your car, it's only fair they get some damage too.
I clipped drivers mirrors with some nobhead the other day, they just swing out round parked cars and expect you to shrink the size of your car.
Still, 12 year old Passat vs brand new black Audi, sure he came off worse than me...

I had a brief curse and then a wry grin the other day when a plonker came past my car in a queue (overtaking down the middle of the road) and smacked my offside mirror forwards. But the shower of glass from his mirror and casing rolling down the road made up for it.

Not even a mark on the beemer :D

I help my mate out by driving a truck for him sometimes, a prius taxi tried nipping up my offside in the wrong lane to take the same left as me. The car in front of him nipped in front of me no problem and then he tried forcing me into the lane to my left which he was never going to do when he was not even half way along my side.

I could not keep my eyes on the mirror and heard a small crunch so assumed he'd folded his mirror in. He did not stop me so I assumed there was not a problem and hoped he'd learned his lesson.

I got a call from my mate later in the day to say the guy reckoned I'd knocked his n/s mirror off and it was my fault. When I got back I showed my mate the roundabout and which lane I was in on streetview. It was clearly not my fault and you could even see a small mark in the dirt on the last 1/4 of the van where his mirror had touched my van.

My mate agreed it was clearly his fault due to the circumstances and that it was only his mirror (If I had been drifting out of my lane into his or tried getting into his lane I would have hit his body work rather than the mirror). He said I had a feeling he was chancing his arm as after he had told me his version of what happened I told him the truck had cameras all around so it would be recorded. To this the Prius driver went very quiet and my friend had deduced he was telling B.S.

If you've ever driven in London you will know how bad the Prius Taxi drivers really are.

Every week I'm in central London, it's the Addison Lee you gotta watch out for, not one of them can drive.

Unless you have video evidence to back up what you say (or even then) it will be 50-50.

Save your fight for something else.
