Car accident liability

Travelling down a 2 way st with multiple parked cars on the right hand lane. Car travelling towards me overtakes the parked cars and passes onto my side of the road.

I've moved over to give more room but the driver of the other car switches his full beam on making it very difficult for me to see resulting in the driver of the other car hitting me.

I've tried to stick to the facts as much as possible here but am I right in thinking I am not at fault?

    How did the other driver flashing his lights/full beam cause the accident? I think there are some details missing there.

    Where was the impact damage?

    No doubt the other driver has a different version of events, so 50/50

    What happened and what you can prove are likely different.

    Insurers will probably go 50/50 unless you can find an independent witness

    I managed to get witness details at the scene but whether they come forward or not.

    I can't think of an scenario where by he can lie and it be my fault.....
  • So the other driver didn't flash his lights he put his full beams on whilst driving towards me making it difficult for me to find a way of letting him pass, without crashing into the curb or him.

    Why didn't you stop/pull over prior to the accident?

    What was the damage?

    What exactly have the witnesses stated?

    If offered two choices of crashing into kerb or car I think I'd choose kerb, of course watching for pedestrians. Did this happen during dark as you say you were dazzled by his lights?
  • I did stop, he complained thst i had stoped in the middle of the road the road so it was my fault.

    The front drivers side wheel is broken and facing in the Wrong direction

    The only comments I got from the witnesses was that it wasn't right and they couldn't understand why he was blinding me with his lights.... This was pretty much all I gdt plus their details to follow up.

    I didn't swerve into him or the kerb I just stopped because I couldn't see.

    Yes this was at night so was poor visibility.
