Back dating a default

    Hi ALL

    I have had a final response by telephone on this.

    Marlin have agreed that both accounts should have been defaulted! They have said they cannot register another default but will remove this from my file at the end of May when the other default is due to drop off. I have asked them to confirm this in writing to me.

    This is a massive result for me as it means the adverse data due to be on there for many more years is now going to be gone in May.

    Thank you all so much for your help.

    For all those in a similar position please see below success after complaint!


    I am writing further to our e-mails dated 04 and 24 March 2015 and our telephonecalls which took place on 17 April 2015. Iam sorry that you are unhappy with the service that you have received from usand I hope I can resolve this issue to your satisfaction.



    Our understanding of your complaint

    You were entered into a 'special arrangement' by Barclaycard to preventthe account from defaulting in 2007. However, this was discussed betweenBarclaycard and Payplan and you did not agree for the account not to default.



    Our investigation

    Barclaycard haven't confirmed to us whether you signed anydocuments in relation to the special arrangement. If youraccount had defaulted when you believe it should have done, the entry would nolonger be appearing with the Credit Reference Agencies("CRA's") and therefore we have made the decision to nolonger report this account to the CRA's.



    Conclusion

    I am sorry for any concern and inconvenience this matter may have causdyou. I understand after speaking with you on 17 April 2015 that you arehappy with the outcome of your complaint.



    This is our final response under the terms of ourcomplaints process but you are welcome to contact our office if you wish todiscuss our response or raise any other queries. Should you remaindissatisfied with our resolution of your complaint you can refer matters to theFinancial Ombudsman Service (“FOS”) within six months from the date of thisletter. For more information please read the enclosed guide ‘Your Complaint andthe Ombudsman’.
