Depends which company is reporting data to the credit reference agency.
If the entry on your credit file is in the name of the debt collectors then only they can update it.
If its in the name of the original creditor then it is the original creditor who is still liable for ensuring the data is accurate. But the debt collector would inform them of payments you make so they can update your file accordingly.
In the latter scenario the original creditor would need to agree with the backdated default.
What about if the Original Creditor marked the Default, which was then marked as Satisfied(DA) when it was passed to Aktiv?0 -

No there are two entries
MBNA - Marked the default, then marked as satisfied- Debt assigned
Then Aktiv Kaptial reported it until it was paid off
So who can change/remove the default?0 -

Hi All,
I have read a little online that the ICO have changed their stance on AP markers and defaults. I have a nasty feeling Marlin will reject my complaint and the ICO will back them up as I have been on a DMP.
Seems so unfair as if I had not bothered to pay a penny until they defaulted me and then entered the DMP all my negative credit would be long gone.0 -
Dear all, sorry to jumb on to my matter.
Please advise. We found a default notice on my credit file last month from 1st credit. I contacted them and asked for some details of what that is. They say they bought it from marks and spencer. I asked for all necessary evidence. I got a letter saying they bought it from M&S on good faith. but have not got a copy of default notice issued by the original creditor. they also said they didn't issue the default notice.
Please advise how can I challenge them to remove this account from my credit file as this is seriously affecting my credit file. I am unaware of the m&S account. please advise

Haven't heard anything from Marlin since my complaint, although I still remain pessimistic.
Has anyone had any experience similar with Marlin and got them to back date a default?0 -

Hi All,
A small update and a question. I have still heard nothing from Marlin (other than a letter acknowledging my complaint).
I got a little excited when I checked my Equifax acct and saw that the account I disputing had vanished from my file. Sadly it turns out that is temporary until they get a reply from Marlin.
My question is is there a maximum amount of time that Experian and Equifax leave for a lender to respond before they just remove it permanently?
This is dragging on and I am impatient lol

Hi All
Another update. I have been sent a holding letter from Marlin saying they are still investigating (dragging it out). I have also had a letter saying Marlin are now Cabot.
I am hoping no news is good news, I really need this off my file.0
