Tv Consumer rights Need help

Hi all , I have had a Samsung tv from littlewoods less than 18mnths old, after 5 months it developed lines down the screen which I called Littlewoods about but they said I need to call manufacturer which I did and Samsung sent a sub contractor out to fix the tv, which they did. Two days ago the same problem occurred so I phoned Samsung again but now its out of its 1 year warranty they will not help they gave me the number of the shop who fixed it last time ( who are now out of business ) and another shop who want £160 to just look at it when I have the details of the fault from last time. All local tv repairs want to rip me off one even saying id need a new screen (£400) as that's what they done last time but I watched them fit a panel in back of tv not a new screen. Do I have any duty of care rights for a part that is unfit for use as this is now second time in under 18 months ? Any help would be greatly appreciated thanks in advance.

    Your rights are with whoever you purchased from (littlewoods).

    However, as its more than 6 months from purchase, they may required you to obtain an independent report stating the fault is inherent and not caused by misuse for example. They (littlewoods) will also be liable for the cost of the report if the report finds in your favour.

    Speak to littlewoods first and see if they require such a report.

    Does not matter Samsung are not responsible under SOGA .
  • So best advice would be to phone back littlewoods and argue til blue in face ?

    Know who's responsible

    When returning items, beware shops trying the oldest trick in the book: saying they're not responsible for the shoddy goods and you must call the manufacturer. This is total nonsense!

    If a company fobs you off by saying “go to the maker instead”, it's wrong. It's the retailer's job to sort it.

    It doesn't matter if it's an iPod from a high street shop or a designer frock from a department store. If something's broken, torn, ripped or faulty, the seller has a legal duty to put it right as your contract is with it.

    Just tell them that you entered into a contract with them, not the manufacturer and therefore it is their (littlewoods) responsibility.

    If they still wont budge then try telling them that misleading consumers about their rights can amount to a criminal offence under the CPRs.

    Even better, ask them to confirm their position (that its nothing to do with them) in writing.

    Does it matter that the tv was fixed though when it broke first time does this then switch to Samsung to rectify

    If Samsung fixed the TV without Littlewoods' prior knowledge then Littlewoods could try to disclaim any liability. If however Littlewoods had advised you to go to Samsung then Littlewoods are still the liable party.
