Can I get a full refund and keep the faulty item?

I bought a coat from FatFace on 16th Dec. The coat was £95 at the time. Later went into the sale for £45 (grrr) but I love the coat so didn't mind. Until today when I found the arm of the coat has a huge hole in it where the stitching has come away at the seam and if it went all the way round the arm of the coat would come off.

They don't have the coat anymore as all went in the sale.

I still have the receipt showing the full price I paid for it (Thank God!)

As I say I love the coat and could probably get it fixed as it's not ripped. If I took the coat back to the store could I ask for a full refund and still keep the coat?

    You can certainly ask, but expect them to say no. Legally you're not entitled to a refund at all if they can repair it.

    They gave to repair, replace or refund. You can specify a preference but can't force them to do something disproportionately expensive.

    They are more likely to let you have some money off for the damage or just offer you a refund (in exchange for giving the coat back). You can't realistically expect them to let you keep the item and give you your money back.

    I doubt they would let you have the coat and a full refund. Perhaps you can try and get them to pay for the repair and give you some money back of the cost of the coat.

  • Nope that's fair enough - I thought it would be a long shot!! I want them to repair it as I love the coat but I doubt a high street store like Fat Face will do that. I guess I go with asking for some money back to pay for repair and keep the coat...will see what they say!

  • I'm planning on returning this item today (not had a chance before now). I think the likelihood of me getting it repaired is low as it would mean someone taking out the lining to get to the arm.

    So considering I have the receipt showing I pid full price for it can I expect them to give me full price refund even though it's been in the sale? What law do I quote if they try to fob me off with the sale price refund? Thanks

    I think most issues are people taking sale items back and expecting to get the pre-sale price.

    I've taken back full-price clothes before during a sale and was refunded what I paid.

    I must say though, Fat Face try to make you jump through hoops etc, including giving a credit note rather than a refund.

    I bought something online after talking to one of their sales reps, and was assured that I could return to a store for a refund. When I got there, they flat out refused to refund me, after a lot of calm and assured arguing they got on the phone to head office and eventually refunded me, though through gritted teeth.

    I cannot stand that kind of policy so I don't shop with them any more.

    Ok. Well I will fight tooth and nail for the money back. I need a new coat and there isn't one in FatFace that I like so I need to buy one to replace theirs that became faulty. As long as I can argue that I have a RIGHT to the full money back I will be sticking to that.

    Have you contacted them at all? I would maybe suggest sending them a message on Facebook, since the social media people will be at head office and could probably ask the relevant parties.

    Why can't you just get a needle and thread and mend it? It'd be cheap, simple and you'd still have the coat you love.
