Moloney erred and performed gymnastics to let PE win.

Moloney was mislead by the heavily-redacted contract, and believed what the PE lawyer told him. If he'd seen the unredacted contract he'd almost certainly have thrown out the claim and we wouldn't even be having this appeal.
  • The cheque arrived.

Or...he would have found a fudge for that too.

    Agreed

And with due respect something that has been reasonably obvious from the outset.

(And those with particularly acute eyesight will be able to read what my avatar actually says. Clue HHJ Moloney's christian name is Patrick).
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

  • What is the correct etiquette here? Should I write to PE to thank them for the cheque? Or just send a thank you card?
