Entitled to a full refund

Hi,

I purchased a watch from an online retailer in August 2014. In November one of the numerals fell off the face inside the casing so I contacted them for a repair. They told me the manufacturer deals with repairs directly so I contacted them. The manufacturer said the service centre was closed until the new year they would let me know when new repairs were being accepted. I was fine with this but its now Feb and the service centre is still not open. They are replying to my emails but I have lost all faith.

I don't even want the watch repaired now - I would like a full refund so I can buy a different watch. The online retailer keeps pushing me in the direction of a repair and won't accept my request for a refund.

Am I within my rights to claim a refund? Or do I have to accept a repair.

I'm thinking of claiming via my credit card company under the Section 75 rule. If I did and failed - would this then rule out a repair.

    SoGA says that the retailer must offer either refund repair or replacement. So you have no real right to force a refund.

    S75 is likely to fail as you often have to show the company is not meeting their requirements, but in this circumstance they are.

    This is interesting...the manufacturers service centre was shut and is still shut. I should at least push the responsibility of repair onto the seller. Or try to get a replacement.

    Who is the manufacturer? A service centre still closed for Christsmas in February sounds absurd.

    That's right... you should.

    Read this short extract from MSE's Consumer Rights guide:
    Know who's responsible

    When returning items, beware shops trying the oldest trick in the book: saying they're not responsible for the shoddy goods and you must call the manufacturer. This is total nonsense!

    If a company fobs you off by saying “go to the maker instead”, it's wrong. It's the retailer's job to sort it.

    It doesn't matter if it's an iPod from a high street shop or a designer frock from a department store. If something's broken, torn, ripped or faulty, the seller has a legal duty to put it right as your contract is with it.

    Personally I would be pushing the online retailer for a resolution. Who did you buy it from ?

    And if you click on the link about stockists it says that they're website is the sole supplier!

    So unless the OP purchased from an unlicensed supplier then the seller and manufacturer are one and the same .... making it an even more rubbish service.
