SoGA says that the retailer must offer either refund repair or replacement. So you have no real right to force a refund.
S75 is likely to fail as you often have to show the company is not meeting their requirements, but in this circumstance they are.
Creditors are wrong to reject a claim on that basis. They have joint and several liability which means you dont even need to approach the retailer at all - just its often the quickest way to get a resolution.You keep using that word. Hi All,
My adventure is still going on! I eventually had the watch repaired. When it was returned back to me, it was broken again. The same fault but a different number. I sent it back for repair again. I got the fixed watch back on Friday 20th. Yesterday it broke again! The same fault but again, a different number. So three of the same kind of fault in total.
The retailer is not handling it at all - their response below. Is there any hope for me getting a refund now? I would even be happy with a totally different watch at this point.

I hope you are well and I'm sorry to hear about your watch.
It seems this is a much more serious fault than previous. Have you contacted Uniform Wares to explain that this has happened for the third time?
As we are not aware of the manufacture or repair process of these watches we can not in this instance explain why your watch continues to be faulty.
This is an unusual fault which can only be explained by Uniform Wares.
We are very sorry for the inconvenience this has caused.

I had composed a detailed reply (a Letter Before Action suggestion) but the forum went down when I posted so I lost it. (I'm not typing it out again - sorry).
My suggestion is to either initiate a S75 claim, or send the retailer a letter before action, rejecting the watch under SOGA as not of satisfactory quality, for a refund (including initial delivery if applicable, and any costs borne during the 3 repair attempts) and also for any costs you might incur in returning the watch. Give them 14 days from the postmark date on the letter else you'll raise an MCOL claim wherein the costs of bringing the claim will be added to the amount claimed.0
