Can I get any money back?
Bought an LG G3 SIM free from Expansys for £365 + P&P.
It arrived, I started using it, notice it was behaving super slow compared to my old Nexus 5, which I had sold.
Contacted LG, they claim I may notice it slower because of the extra software etc.
Carried on using the G3 for another few weeks, presumed I was just being a bit daft. Tried a friend's G3 and his seemed to perform much better.
Contacted Expansys to register the potential fault, they extremely reluctantly agreed to pass it over to LG for testing; it took another month to get to this point.
Had paid for the G3 on American Express. Spoke to Amex. They said if there's a fault and Expansys won't fix it I have 12 months cover with Amex.
Got a Sony Xperia in the mean time from fleaBay, fed up waiting around and didn't want to continue using a potentially faulty product, or a product that wasn't faulty but I wasn't happy with.
Heard nothing from Expansys throughout. Received the G3 back today 16 days later and the report states the fix was Software Update and "screening". I already had the latest software on it anyway!!!!!! The cheek.
Value of the phone is now only 299 new or 250 ish used on fleaBay and I am perfectly happy with the Xperia.
I would have preferred a refund from Expansys but obviously they didn't want to do this.
Do I just have to take this £100+ loss on the chin?

The options for returning a phone after a few weeks is always going to be repair or replace so you were always going to end up with two phones
I guess so, but I just feel a bit diddled as LG commented the phone would likely be slower and so I accepted that.
But upon using a friend's phone, his was significantly quicker. That misinformation cost me time which lead me to be unable to return the phone and get a refund, eg, 7 day DSRs.0 -

I tried factory reset before I sent it back. No improvement. I mentioned this at the time to Expansys that I had performed factory reset. And yet I reckon this is all LG did too. "Software update" in their repair report.
I thought the phone was slow by design because LG said this after I contacted their support (bearing in mind my previous 2 phones were LG so I had a level of expectation), but then I started to think it's a fault, by which point 7 or 14 days go by. Bye bye DSR entitlement.
I just feel shafted as I accepted the answer of LG that the phone may seem slower, and I put up with it, but then seeing my friend's G3 is significantly quicker and my DSR refund is gone. Meanwhile, phone drops in value by £80 new.
So what now if I sell the phone on eBay as used and someone else receives it, they're disappointed too, and then they claim the phone is faulty with me? I'll be even worse off.
Just don't know what to do for the best now.0 -
The vendor under SOGA is your route .
But i think you lack actual evidence of a fault .
Seemed is not covered under SOGA ..
LG factory set would not have been the same it would have been a clean flash of software as the original software may have been corrupt .0 -

Yes, indeed that is my problem, so it would be very difficult to prove.
If I'd have trusted my instinct on the phone with hindsight I should have sought out another device straight away to compare it.
I think I'll have to take the hit on it and chalk it up to experience.
