We'll, I've used the phrase "lighten up" twice but that seems to be an alien concept so let's be serious and logical. ...except that if "what happened" is somewhat irrelevant then where do we go from here.?

    To the NEWBIES FAQ sticky!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

The legal right (or not, as it turns out) for a private parking company to arbitrarily charge someone for breaking some arbitrary rules they've made up?

  • Sorry for the late reply, I've just returned from work. I visited the retail park over the weekend and did view two signs located near Starbucks.

However the signage was placed on lamp posts and poles at a height where I would not have noticed it if just walking by or driving within the vehicle which my view was also obscured by my roof and side windscreen pillars. As stated before it was also night time where vision is reduced further.

I have also had a look at my bank statement which i printed out and it appears the amount taken for my patronage there was not taken till the next day. Will this be a detriment to my appeal if I wished to use this as evidence.

I will most likely be using the 'first appeal to PPC' template. Is it possible to incorporate the fact it was night to this or is this an irrelevant mitigating factor that should be ignored? Furthermore if the redacted bank statement is reasonable to use as evidence is there a special way to include this or would be a simple line put into the appeal as 'please see the attached statement highlighting the keepers patronage at Starbucks as a genuine customer'.

Also at the top of the new template in bold green is this line, 'Yes it needs your postal address, and yes it needs your name as keeper.'. I understand my address is needed for return correspondence but with the name as keeper is this used instead of my name above my address or is this to reiterate the use of third person. Also is it fine to end the letter with my actual name although most of the letter will be 'keeper' and 'the driver'.

    Thank you for your patience.
