Wedding dress LATE. What are my rights?

    You can definitely make time of the essence after the contract has formed in any Sales Contract, as defined in The Consumer Contracts Regulations.

    The retailer must deliver the goods by the agreed time, and if no time is specifically agreed then that time is 30 days.

    If the consumer makes time of the essence before the contract is formed and the retailer fails to deliver then the consumer can declare the contract void immediately and get a refund.

    If the consumer didn't make time of the essence before the contract is formed and the retailer fails to deliver then the consumer can state a reasonable period for the retailer to deliver. If the retailer still fails to deliver then the consumer can treat the contract as void and get a refund.


    Am perfectly happy to be shown to be wrong, but I can't find it in the 2013 Regs, which I assume are those to which you refer given that there are no such Regs that you cite.

    I again ask, what did the contract have to say about delivery?

    I missed out the part of the name in brackets, but the Consumer Contracts Regulations definitely exist. The regulation I was referring to is quite far down. Section 5, regulation 42: Time for the delivery of goods.

    I was more asking the OP why she'd not visited the shop in person if it was local - hence my quote of my earlier question.

    'Local' to some people could mean yeah, it's only 20 miles way but to someone without their own transport that 20 miles could be 3 bus journeys away.

    So you're waiting for a dress that isn't even made to your measurements? Who's going to be doing the alterations? The same shop? If they can't get an off-the-peg dress to you in the timescales they agreed to, then I can't see the alterations going too smoothly either.

    I can't understand why it takes such a long time to order you a dress that isn't even bespoke. They sound really amateur. Do they have any reviews? What's their reputation like locally?

    I'd give them a final deadline of, say, next week, then advise them that, if this is missed, you expect your deposit returned. Follow up with a letter to that effect also advising that failure to return your deposit will result in your taking them to the small claims court.

    In the meantime, if you can find the time to have a look at other dresses, dresses that you'll be able to buy there and then, I'd suggest that would be sensible.

    Being male, I'm not very familiar with wedding dress buying, but why would someone order a dress which won't fit and takes 4 months to be delivered? If this dress doesn't arrive on time, what chance has the OP got of finding something else that will fit.

    It's standard practice in the wedding dress industry, they don't just have the dresses all made up ready for people to buy, they have to be ordered and made up to the nearest standard size then altered to an exact fit when they arrive. Average wait is 6 months.

    The only way to get a dress quickly is to either have one made by a seamstress, buy a shop sample, or buy truly off the peg from somewhere like Monsoon.

    6 months seems a very long time to wait for a dress. The 1st Mrs Lincroft and I were only engaged for 5 months before we married (no point hanging around, I already had a house), although this was nearly 40 years ago.

    6 months seems a very long time to wait for a dress. The 1st Mrs Lincroft and I were only engaged for 5 months before we married (no point hanging around, I already had a house), although this was nearly 40 years ago.

    It does take that long which is crazy I know! I went to buy my wedding dress in late January when I was getting married in the May of that year, there was lots of head shaking and grimacing when I told them the date of the wedding. I have no idea why it takes so long, I thought 4 months would be plenty but apparently not!

    It absolutely does take that long and it absolutely is crazy.

    OP, how did you get on today? Wedding dress shops totally know the necessity of having your dress turn up on time - and by on time, I mean at least 8 weeks before the wedding to allow for fittings etc!!
