Wedding dress LATE. What are my rights?
Comments

It is from a local wedding dress shop and the wedding is abroad so I need the dress for now so that it can be taken in etc and taken overseas on the day of purchase it was stated that the dress was needed for end of this month latest for all the above0

So does that mean you CAN insert a ToE clause post facto?
I would have thought a competent wedding dress shop would always ask the date of the wedding as well as the desired date of delivery.
Therefore in this case it should be implied as part of the contract that time is of the essence. So with a wedding dress there's always an absolute date of performance for the contract.

OP has already said the shop is local(post 12)0

When is the wedding? Is the dress LATE for when it was expected or LATE for the wedding?
Late for expected delivery but I need it altering and again they are aware of it as they keep asking do I want their Taylor to do it0 -
What date is the wedding?
How much deposit have you paid?
Why have you phoned the shop rather than actually visited? If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales0 -

You can't simply insert a "time is of the essence" clause, that would have had to have been done at the outset.
What does the order form and T&Cs have to say about delivery.
You can definitely make time of the essence after the contract has formed in any Sales Contract, as defined in The Consumer Contracts Regulations.
The retailer must deliver the goods by the agreed time, and if no time is specifically agreed then that time is 30 days.
If the consumer makes time of the essence before the contract is formed and the retailer fails to deliver then the consumer can declare the contract void immediately and get a refund.
If the consumer didn't make time of the essence before the contract is formed and the retailer fails to deliver then the consumer can state a reasonable period for the retailer to deliver. If the retailer still fails to deliver then the consumer can treat the contract as void and get a refund.0 -
When is the wedding. If for example you are not getting married until june then neither you nor the shop are realistically under a huge amount of time pressure.
If the wedding is within the next month then absolutely you need to get an update and have a back up planI am a Mortgage Adviser

Paid half and I have called and been in to the store. The wedding is in march but as mentioned I need to get it sooner rather than later as it needs alterations and they are aware of this fact.
Blood from a stone comment not helpful, I am a mother to a young poorly child so not actively sat staring at my computer all night but attending to my child.
