If there was a will the monies will be shared out as per that document - if he was sole next of kin he can get the money if not at best he will get a pro rata share.

I did the claim as I made the payments on the loan although it was her house I took the loan out for improvements to the house therefore her name was Alison on the loan although it was me who took out the loan
This is what's confusing me. The OP says THEY took out the loan.
If it was the OP's loan then it looks like the Claims Company have looked at the wrong name on the document and made the cheque out incorrectly.0 -
It was just an enquiry if I don't get the money I'm certainly not going to worry about it, I couldn't care less, as I was paying for the loan out of my money I was told I had a claim. I got some back and there was a cheque in my mums name as well as her name was on the loan documents as it was her house. I paid the whole loan not my mum who made no payments whatsoever. Thanks to those who took the trouble to reply even if I didn't really get an answer to my original question0

The answer to your original question is 'no'. You can't cash them or change them to your name.0

As I said earlier: It doesn't matter who filled in the application form for the loan, made the payments for the loan, or filled in the PPI claim. The PPI refund will be in the account holder's name, and if the account holder has passed away, the cheques will form part of their estate.
You cannot pay cheques made out to somebody else into your account.0
