                    I have two cheques in my mothers name as part of a PPI settlement. The loan was some years ago and she has since passed away. Is the anything I can do about cashing them or putting them into my account?

            Did she leave a will.
These cheques will form part of her estate.make the most of it, we are only here for the weekend.

            I did the claim as I made the payments on the loan although it was her house I took the loan out for improvements to the house therefore her name was Alison on the loan although it was me who took out the loan0

If the loan, and therefore the PPI for the loan, was in your name, the PPI refund will be in your name, not someone else's. If the cheques are in your name, you can cash them into a current account in your name.
If the loan, and therefore the PPI for the loan, was in your mum's name, the refund will be in her name. It doesn't matter who filled in the application form for the loan, made the payments for the loan, or filled in the PPI claim. The PPI refund will be in the account holder's name, and if the account holder has passed away, the cheques will form part of their estate.0 - 
            I think your mum's estate need to be reopened and someone else needs to be appointed as executor. My guess is that this won't be either quick or easy. How much are the cheques for?
I would contact the probate office to get a feeling about whether it's something you can do yourself, but you may have to get a solicitor involved.0 -

Was the loan taken out in your name or your mother's?0 - 
            Looks like mum got a loan for son with PPI and son is now trying to reclaim this claiming he was making the repayments.
Legally he has no claim on this money.
If there was a will the monies will be shared out as per that document - if he was sole next of kin he can get the money if not at best he will get a pro rata share.
If there was no will the rules of intestacy will decide who gets the cash.0
