UKPC PCN at Park Royal London

Whilst having the bathroom of a rental flat in Kenton refurbished I decided to utilise the nearest PureGym by extending my membership from Leicester giving me the ability to use PureGym at Park Royal, London. My day started earlier at 5am every day because I had to let the builder in at 8am and had the additional challenge of the morning traffic between Park Royal and Kenton. At 5am it was still dark and the parking at Park Royal outside the PureGym isn’t exactly well lit. Day one was ok however one day two I received a Parking Ticket from UKPC at 7:09 in the morning for parking in a disabled bay which incidentally wasn't very well signed. Having read a few post about UKPC I decided to ignore it. Having returned from our Christmas/New Year’s break I had a reminder stating the fine had gone up from £70 to £100 and Last week I had another final reminder stating I had 14 days to settle the PCN. Having stayed in Kenton for the remainder of the week I refrained from parking in the same bay and observed other gym members had parked in the same bay during the same period and did not get a parking ticket. I also have photographic evidence of this too. Whilst I have read many things about UKPC I would just like some reassurance on whether or not I have to pay this PCN. I would welcome comments from other people who have had similar experiences and understand what your outcome was from non payment of your PCN.

    Ignore the PCN and do nothing
    If you submit the NEWBIES thread first appeal, even late, UKPC will likely cancel it. You can do this online easily.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    On 12th February I received a response from UKPC to the appeal letter which I sent them on 26th January 2015.

    They have addressed each of the points in the Appeal letter and concluded their response with giving me 3 options.
    1. Pay the parking charge detailed above at the reduced rate of £60.00 to UK Parking Control Ltd. PLEASE REFER OVERLEAF FOR PAYMENT OPTIONS AND ADDRESS DETAILS.
    2. Make an appeal to POPLA – The Independent Appeals Service, POPLA, PO Box 70748, London, EC1P 1SN within 28 days of the date of this letter (12/02/2015) or by making an appeal online at www dot popla dot org dot uk. Please note the if you wish to appeal to POPLA, you will lose the right to pay the charge at the discounted rate of £60.00, and should POPLA’s decision not go in your favour you will be required to pay the full amount of £100.00. If you opt to pay the parking charge you will be unable to appeal to POPLA.
    3. If you choose to do nothing the parking charge will automatically increase after 35 days from the date of this letter (12/02/2015) to £100.00 and the matter will be passed to our debt recovery agent, at which point you will be liable to pay an additional charge of £60, in accordance with our terms and conditions of parking, and further charges will be claimed if Court action is taken against you. Any unpaid Court Judgement may affect your credit rating.
    I decided to ignore their response, which means I have missed the opportunity to appeal to POPLA too. I have also received a letter from their debt recovery agent DRP (Debt Recovery Plus Ltd). As outline in third option in the letter from UKPC, the so-called parking charge has now increased to £160, which needs to be paid by 08/04/2015. Furthermore I am concerned this letter is addressed to me as the registered keeper of the vehicle although I have not yet informed them of the actual driver.

    As I have read on numerous occasions on this forum, I’ve taken the approach to IGNORE all further correspondents from UKPC, however the letter from DRP looks all official and I am more concerned about my credit rating and any potential court action which they indicate in their letter.

    Please can someone advice what I should do next.

    its all in the NEWBIES sticky thread, post #4 deals with debt collector letters , especially from DRP

    but as you were silly and ignored the popla code and deadline you have little choice but to put up with debt collector letters for 6 years

    the correct procedure was to use the popla code and get it quashed at popla, which means it would probably be cancelled by now

    too late now though , so in future, appeal (including popla)

    as RK, they can hold you liable due to POFA 2012

    If you'd have read this, you would have seen that ignoring a PCN is the last thing you should have done.

    However, now you're at debt collector stage, paradoxically, 'ignore' is the current advice. But you could have killed all of this off if you'd read and followed the NEWBIES sticky. You need to watch out for any LBA/LBCCC or real court papers served by the PPC (not the debt collector, because they can't!). Now please read the NEWBIES sticky, post #4 regarding debt collectors.

    You could now be getting grief for up to 6 (six) years. It probably won't drag on that long, but statute allows for any alleged debt to be pursued for that length of time before it 'times out'.

    That's what it's designed to look like to take in gullible people, and sorry but you would appear fair game!
    You have ignored the advice on here, and are now asking for more advice.
    All you can do now is carry on ignoring the useless debt collectors that Debt Recovery Plus are, and their alter ego Zenith who will pop up next with empty threats.

    It always amazes me when people ask for advice, ignore it, know better, do their own thing - then balls up!

    Perhaps the OP paid too much attention to the one and only (anonymous) respondent to his 'Poll' (why a Poll?) who suggested ignoring the PCN.

    @OP - how do you know that wasn't the response of a PPC?

    I have now received the first of those letters. It threatens me with a County Court Judgement, however I haven't actually given them a name of the driver, they are only writing to me because I am the registered keeper.

    What I would like to know is can they legally issue me with a CCJ? or is this simply a ploy to get me pay?

    Would appreciate your comments.

    the answers above are based on the assumption that the letter are nice "red" ones from a debt collection company , if they are from UKPC please advise us ,

    Who's issuing who with a CCJ? Do you understand what you're asking? Everything they do is a ploy to get you to pay!

    You've exhausted your appeals opportunity, so it's at debt collector stage (the only part of this process which is effectively 'ignorable'), so that's just what you just need to do - short of a LBA or MCOL.

    But please bone up on CCJs (Google is your friend), as what you are asking suggests no independent research of your own prior to posing such questions!

    If this was a windscreen ticket, the driver has already had the opportunity to appeal, so the 'naming the driver' ship has, I'm afraid, already sailed.
