PCN on a lease van

Hi,
I am after some advice please. I drive a company van which is leased and on the 1st of December I received a letter from the lease company saying they had received a PCN that was issued on the 18th of November for parking in a permit only car park. The letter also said they had passed on my details to the PPC and that I should wait until I receive a letter from them before any action should be taken.
So I waited.
On the 9th of January I received the PCN demanding full payment, there was no option for a discounted amount as specified on their signage. I was unsure about their demand as it said they had requested my details from DVLA as the registered keeper of the vehicle. If this was the case surely I would have received the NTK on the 1st of December. I have already had an appeal rejected should I appeal to POPLA on the same grounds. Any help would be appreciated.

The lease company received the NtK - they are the registered keepers after all.
However, after they notified the PPC of the hirer details (which it sounds like they did, so they followed the BVRLA guidance), then YOU should have received a Notice to Driver/Hirer - this should also have offered the discount period. (Unless there was originally a windscreen PCN - was there?)
If you have an appeal rejection and a POPLA code, then compose a proper POPLA appeal. You could always add an item saying that the NtD did not offer a discount period therefore it was non-compliant with the BPA Code of Practice.
It's a pity you didn't come here first before sending in your PPC appeal. (We have a good template in the NEWBIES thread).

Thanks for the reply, the PPC is UKCPM. The rejection letter had photographic evidence and the reason it was issued was for not displaying a permit. I have been back to the car park and there are a couple of cameras and several signs about saying it is permit only, but it outside a takeaway (land owner) so as long as you use the takeaway you are probably o.k. but I did not, I was about 20 mins there. £100 charge is steep for 20 mins and I don't know if I could go down the no GPEOL route as it was a permit only car park.
My appeal was done through PTAS which have ceased operation though I did receive a POPLA number.0 -
What date does your POPLA code expire?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

You can go down the GPEOL route. Who you are or why you got it doesn't matter.
UKCPM just use a standard template and change the wording btw. They literally make no effort what so ever.
The rejection letter to the first stage appeal contains this paragraph:"If all motorists didnt park where they shouldnt, paid where they should, didnt overstay and followed all the specified condition at the sites we look after for our clients, these cost would not exist"
Wait till you see their cost breakdown.
Sounds to me like you have their NTK now am I correct?
If so send the stage 1 appeal to the appeals address on the NTK.

I received the PPC rejection letter 17th of January (dated 15th) so I assume the POPLA code is still in date. The letter also says my appeal was submitted outside the 14 day discounted period therefore I am liable for the full amount and have 28 days to pay.0 -
OK. Draft a POPLA appeal (search my threads and trawl through me !!!!!!!! myself and youll find a UKCPM POPLA appeal).
Might want to google POPLA code checker and see if your code is valid. Theres a problem with the checker so if it says your code expired Feb 2014 then obviously thats an error and you should be fine.
You should let people know what your initial appeal looked like. Point 5 in my appeal might not be relevant.Mike172 vs. UKCPM

Use the PoPLA code to obtain the 100% discount. Check the code is valid on the Parking Cowboys website and get reading the How to Win at POPLA section of the NEWBIES thread.

Thanks for your advice, the POPLA code is coming up with Feb 2014 but as you say it is probably just an error, I will now have a look at getting an appeal together, should I include scans of the documents from the lease company and PPC as evidence?0 -

As I say point 5 might not be relevant on mine. Did you copy and paste the stage 1 appeal on here?
What did your initial appeal to UKCPM say (might be worth removing any specific info btw)? Did you Identify driver?Mike172 vs. UKCPM

Hi,
