I don't for one second think ebay are in the wrong. Sorry if I didi not make that clear. It was our choice to purchase outside of ebay. Its our own fault that we have no leg to stand on. This thread will hopefully warn others not to do the same.
As for ebay, I rang them and they took it very seriously. After all they are losing a lot of money each time this company deals outside their website.0 -

Why not just let them replace the bed???"Love you Dave Brooker! x"

I agree it doesn't always imply any kind of dodginess. The Sun and The Times are owned by the same company, they are both essentially doing the same job but in different markets. That said, recent court cases would show that they are pretty dodgy!Just because they trade under different names doesn't mean they are dodgy. Plenty of companies trade under lots of different names depending on the market they are targeting..0 -

Well we are now. When we realised how unprofessional they were we just wanted to get a refund and go to a bed shop instead. Our worry is that if the bed falls apart in a week or so, then we'll just have this fiasco all over again. And it is a lot of money we have spent.
We now feel that a replacement is our only option since this company ignores the law - i.e. if they pretend there isn't a fault then the law does not apply.
As for them being dodgy - I think any company that gives you a receipt with a different company name on, and who puts a non existent address on their ebay page, asks for cash up front and asks you to sign before you see the goods, AND claims there is no fault on a photograph showing a very clear fault and who then refuses to come a inspect it to be sure because it would cost them too much money, obviously isn't the most honest/trustworthy company? Maybe that is just me though. And for them to get aggressive when you ask for their real business address! Hmmm. This company should not be allowed to " distance sell" , they are not cool at all!0 -

That isn't right.lula_tallulah wrote: »We now feel that a replacement is our only option since this company ignores the law - i.e. if they pretend there isn't a fault then the law does not apply.
As stated by RFW, during the first 14 days after delivery you can cancel the order for any reason.
You may have to pay for the cost of return, but you should get refunded all monies paid.
You appear to have now reached an agreement with the seller, but if you want more information on 'distance selling rights' you could have a look at this section of MSE's Consumer Rights article.0 -

The business address they gave me is very different, and in Huddersfield rather than Dewsbury.
It is also the address of a shop called The Bed Factory and a company called Joseph International who say they are a furniture delivery service. So they operate under 5 names so far that I know of!
{I have edited out the address for fear of breaching forum rules)
I have a bed on my eBay watch list from BedExpress123 and their contact details on the page are
Mark Shaw
Unit 32
Wharf Street
Dewsbury
West Yorkshire
WF13 9AH
United Kingdom
So I did a Google search for Wharf Street Dewsbury and the general postcode came up as WF12 9AT, which isn't that different at all.
I would never buy from an eBay shop over the phone, especially by Cash on Delivery because then you are not covered by eBay's Money Back Guarantee. But after hearing your story, I don't think I'll buy from them at all now!0
