Grove road is a public highway, the car park is in the grounds of some flats at the end of the road.

I will add that to my appeal that I am submitting later this week

    Simple solution to this one.

I would let them take me to court and ask them on what date I am supposed to of entered into a contract with them.

If/When the court docs arrive, fill them in giving your reasons for you disputing the claim (i.e. no date of contract, thus no contract was made) and attach a COPY of the ticket to the docs as evidence.

I doubt whether it will even result in a hearing.

Thanks Tilt for the advice, would you say its worth appealing to the IAS using that as one of the grounds for appeal, or save it for/if court papers appear?

Appeal with as many points as you can, they'll reject it all anyway, but they'll waste more time on it.

But when you win with any/all of those arguments at court, you can then drag IAS over the coals.

Obviously it's up to you. BUT if it was me, I would simply wait and let them take it to court as it will cost them more money because I cannot see how they can prove a contact was made when there is no actual date on the "invoice".

But make sure you keep the original ticket safe. Only send a copy when you file your 'defence' (assuming they actually take it to court).

    Please keep the thread updated.

    Finally an update to give.

I decided against appealing to the IAS and to sit and wait it out. Yesterday I finally received a letter from them, advising they were disappointed I had not paid the fine after my appeal had been rejected. It was the usual "we may take you to court and you may get a CCJ which will affect your credit rating"

I have filed the letter in a safe place and will just ignore it and see what happens in the coming months.

BTW I am due to move house in November, so what are peoples thoughts on writing to them to advise of a change of address?

    Regards

I would imagine you will hear something before then and I would assume your post would be forwarded on to you anyway.

Just make sure you don't loose the evidence!

    Hi All,

1 Year Later and I have another update about this.

Received (via Redirected Post to my new address), a letter from bwlegal which is basically saying they have been instructed by VCS in relation to the Balance Due - this is now £154 - £100 PCN plus £54 legal costs.

They are wanting payment within 16 days, or they will seek the clients instructions to commence legal proceedings against me in the form of a County Court Claim Form in the County Court.

It is signed BW Legal (ie not a name)

What would peoples advice on this be?

One point that may help what people have to advise is that in my house move I seem to have misplaced the PCN notice that was on my car! I do have the photo's that in that this post still, but I am still frantically looking for the original :-(

    Look forward to some advice

Yeh I have those from the post above - its the original I dont have.....

And from reading a bit more on the forum it looks like I need to post my letter from BWLegal as the wording is slightly different according to another post.

Will get these copied and posted as soon as I can
