Internal cracked bezel on tv. Covered in warrenty?

Hi,

Ive had my tv 18 months from John Lewis. Its a 46 inch tv and has an internal crack which has appeared on the edge of my tv. My samsung 46 inch tv 2013 model has a glass thin bezel and i noticed a crack a couple of weeks ago. The crack is getting bigger, you can only see the crack when you stand side on with the tv. There are several cracks now both sides and underneath. The cracks are appearing overnight and getting longer,. The longest (the first) is now 3 inches long.

Ive had to take it to an independent samsung engineer, who said its a common fault but NOT a manufacturing??? Really? So they all crack do they? Is that part of the deal???

Am i wrong to think this IS a manufacturing fault. He said its just one of those things?

John Lewis said they WILL pay for a new bezel. BUT only as a good will gesture to help me out..

What about the 10 days Ive been without a tv and when i collect it, that will be over 100 miles and 6 hours of travel.

So do you think its a manufacturing fault? Would you want any compensation for the inconvenience and money spent on petrol and time etc?

    It really doesn't matter what I or anyone else on this forum thinks.
    The important thing is what JL think, and equally what the terms of JL's warranty are.

    If this is deemed a cosmetic fault for example, and their warranty excludes cosmetic damage, then you are lucky that they are offering a goodwill repair.

    Because a warranty is in addition to your statutory rights, it can include terms like "cosmetic damage not covered", or "the customer must pay carriage to/from JL or their repairers".

    However, if you were to seek a remedy under The Sale of Goods Act, JL could ask you to prove that the fault is inherent, i.e. the fault was present at the time of sale but not necessarily apparent at that time.
    You have already had an opinion that it is not a manufacturing fault, so you may have difficulty finding anyone to state the fault is inherent.

    100 miles, 6 hours travel, 10 days without a tv... probably all down to you if you go the warranty route, but if you take the SoGA option then SoGA states that the seller must cover all the costs of providing the remedy and perform the remedy without significant inconvenience.

    Your choice really.

    So if the fault isnt inherent, what are they saying has caused it?

    Btw, the engineer...do you mean it was an independent engineer that accepts samsung products or that he was a samsung engineer?

    Personally, for my own convenience I wouldn't chase anything more than they've already offered.

    The only extra thing you may have rights to is your costs for the travel. But is it really worth the effort?
  • 6 hours of travel for 100 miles? Are you cycling?

    Cosmetic issues are often not covered by warranties and unless the cracks interfere with the TVs function or pose a safety issue then generally you'll get no help from warranties/ insurance.

    SOGA rights is different but you then get into a burden of proof that this is an inherent issue and not something that you have caused.

    As JL have agreed to deal with the matter that seems the best route to go. Not sure where you are in relation to JL but have you not spoken to them about it being collected? JL clearly arent going to be fixing it themselves in store so its going to be couriered to somewhere else anywhere and that may as well be from your home as from the store.

    To the 10 days without TV? Probably a great thing, we are all far too happy spending vast amounts of our lives sat infront of the idiot box.
