Very Poor Service - Lost Parcel - my rights ?

    I know what you are saying here, but looking at it slightly differently, I would suggest that "loss/theft by an employee of another company" is probably outside the control of the seller. ;)

    Shame very can't be like amazon who accept liability from postage to delivery ..... and shame very unlike amazon haven't sorted this within 3 days which is the waiting time amazon expect

    It is beyond me how companies use yodel .....

    Legally, their disclaimer is dubious, and even so, if you've paid for Next Day Delivery and they've failed to provide it, you should be entitled to a refund of the delivery charges at the very least (no pun intended).

    Practically, this is Very. You've got no chance of getting a refund of the delivery fee from them, and even when you cancel the order they'll you'll still have to argue the toss for them to credit the delivery fee back to your account.

    They've already let you have it. It's been left in the shed / outhouse / porch / garage / neighbours / wheelie bin / next street etc etc.

    Well I have been asking and asking very for a replacement as the camera deal is good - oh no they have refunded me but not refunded the extended 3 yr warranty I purchased on top

    You are mixing up two different issues here.

    Of course Very, just like Amazon and any other distance seller, are responsible for the goods until they are delivered to their customer.

    However, we were discussing whether a delay by a delivery company was outside the control of the seller when considering their responsibilities under the unfair terms in contracts legislation.

    Two entirely different things.

    Apologies what I actually meant was that very will say it's outside of it's control as yodel were responsible for delivery of the item
    What I am saying is surely very are responsible for the parcel from very to me therefore they can't use yodel as a reason not to provide any compensation ? Ie outside of Very control
