  • okay back again i did email and write to parking eye regarding a settlement out of court before i went on holiday but when i got home i had a letter to say they were proceeding to court and got a hearing at the end of this month so i think my only defence now will be to pull holes in the signage locations as there are some blackspots in the carpark in front of the court unlesss anyone has any ideas. they did however send me about 150 pages of previous court documents from other cases (the grandkids needed drawing paper anyway) .

    they have a naughty solicitor , that should know better , and has been repeatedly told not to use this , see parking pranksters blog as to complain . you might want to use this fact to get the case "stayed" or on hold until the results of the case are known .

    I agree, but I would suggest to the judge that it goes to the Industry standard for dispute resolution, PoPLA. If the judge agrees and directs PE to issue a code, you will almost certainly win at GEPOL.

    If however they refuse you can suggest to the judge that, not only are they being unreasonable, they are also wasting the Court's time.
    You never know how far you can go until you go too far.

    Prepare a Unlawful Penalty no GPEOL defence, they have never seen that one off, some go for them , others where the judge is awake do not.
    Land registry search + holes in contract, is the contract with who owns the car park or an agent who does not have authority to litigate and assign litigation rights.
    Known as Locus Standi, it has to be made on authority from end to end from land owner to agent.
    Start looking for holes to pull the case down on what it is built on first.

    Download a copy of ParkingEye v Cargius which shows that "Beavis" doesn't apply in a Pay and Display Car Park.

    And you've hopefully now followed the Newbies thread advice about court claims stage and written to the court asking for a 'stay' for the Beavis case outcome I presume? No-one should be thinking a hearing is inescapable v PE this month, that would be DAFT especially if the Beavis decision is delayed.

    Are you seriously thinking signage is your only defence? Good luck with that, if you've read nothing about Beavis yet and have admitted to being the driver. Read recent stuff from February about the Beavis case and the issues involved, on the Prankster's Blog at least. Don't sleep walk into a hearing that should be stayed.

  • does anyone know the outline details of the ruling hhj molony qc made in favour of parking companies ,parking eye seem to be referencing it alot in their pre court papers???
  • oh i also offered p.e £40 to drop court proceedings but they said they would accept no less than £200 even though the court claim is only for £175

    doesnt really matter since that case went to appeal and was heard over a month ago in the court of appeal and we are awaiting the verdict in 3 or 4 weeks time

    ie:- the Beavis case

    I would assume parking pranksters site may have details about the Beavis case over the last 10 months or so, possibly the details you are asking about, but as coupon-mad said, you should really be getting a stay until after the Beavis judgement by the C.O.A. , not worrying about the Moloney case as the C.O.A. appeal will override it anyway, whatever the outcome
