parking eye summons to court

hi ,my son was caught by parking eye in Fistral car park Newquay on 28/6/2014 he was in the car park for 47mins , i found a summons to county court letter just before xmas ,i sent a defence to court stating that we had not received any earlier correspondence which sometimes happens as we share a very similar address to another property and this is a genuine problem.I also did a quick reccy on the car park and on the entrance sign it states clearly 1 hour free parking ,i also added this in my defence ,however i have today received a 24 page document from parking eye refuting all my defence points also claiming that the "summer time" tariff boards were different from the ones displayed currently but not saying when they were changed over they also say we have no right to appeal through popla as we did not respond to parking eye within 28 days of the original "fine".any help would be appreciated to bring this to a conclusion hopefully in our favour

    Post five of the Newbies Sticky is the place to start - Lots of info on what to do once you have reached this stage of the process.

    And if this relates to your existing thread, you should get back on to it. Posting multiple threads only confuses the issue and won't get you the best advice.
  • i have just looked at the picture i took of the tariffs board a few weeks ago and it doesn't state it is a "winter tariff" board so i am wondering if there ever was a "summer tariff" board or if parking eye are just trying it on again

  • This is the signage map supplied by PE (aprox Jan2014), and it was inaccurate at the time. 004_zpsadbbca6b.jpg

    Fistral has suffered storm damage, so in June 2014, some of the signs were missing. Not sure if it will swing the case, but may be worth adding as part of your case. PE tend not to keep an accurate history of signeage maintenance etc.

    the signs are often obstructed and difficult to read 'specially in the summer.

  • thanks ivor your obviously local i got a picture of the winter board but it dont state the season dates like the council ones would this help to explain the confusion ??

    Ivor took all these as evidence after PE made a court claim against him ... PE lost. ;)
