Sorry but this is clearly a case where the authority has not applied the legislation correctly - if you're capable of posting with such clarity on here then you do not have a SMI.
And no, you can't claim interest on the overpayment.
If a medical professional has agreed the criteria is met then it has been granted correctly. There are issues regarding the original intent of the legislation compared to how it has actually been worded but providing the council follow the wording they are correct until such time as any legislation is amended.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0 -

Why can't i get interest on the money that is owed to me,please explain.
All sorts of people on this site presume all sorts of stuff.....gosh you could fill a bus with them couldn't you
You won't get a penny interest on the money owed.These are my own views and you should seek advice from your local Benefits Department or CAB.0 -
I have been awarded the 25% discount for Council Tax due to my lack of mental capacity and the Council now owe me money for overpaid Council Tax.
What i want to know is,can i get interest on the amount that is owed bc it would have gained interest if it had been in my bank account,but as lost value in todays money.
Not that impaired then.0
