CCJ Creditor no longer exists to pay

Hi There,

I regrettably have a CCJ on my credit file, i was out fo the country when this was processed. I would have paid happily(Annoyingly).

However i am now back in the country full time and am trying to pay the CCJ however the company the money is owed to is no longer trading, or existing!?! I have contacted the court however they cant offer advice. No one seems to know what to do.

Has anyone else been in this situation as there is still 19 months left before it auto clears off my credit file and its only for £400 pounds.

I look forward to any responses.

    What company? Taken over by another company? Changed names?

    Did the company go bankrupt also?

    the company was called Tower Capital, based in Bournemouth. they were forced to cease trading by the OFT (PayDay loan company). However they were allowed to collect payments however this was a few years ago. I have sent letters and the only number i found for them is now disconnected.

    Sorry. Missed that in the 1st post.

    If the CCJ is valid, then paying it will not get if off your credit file. Just get it marked as satisfied. It will come off your credit file in 19 months no matter what, even if not paid.

    If anyone wants paying, no doubt they will contact you.

  • Hi thank you, i understand that it will get removed in 19 months however thats along time when i would like to try and obtain credit. I am willing to pay the amount of 400 pounds however i am at a lose on what my options are in getting it classed as settled/satisfied.

    I wonder if a set aside application would work?

    That you have only just become aware of the CCJ, have no knowledge of any debt being owed to the company and were out of the country and from your research understand that the company have been forced to ceased trading?

    By the sound of it nobody would be able to provide any evidence of the debt, or disput your set aside claim.

    May be something work looking in to or getting advice on?

    As fermi said - even if you can pay it off now, it will still be on your credit report for the next 19 months. Paying it off now won't get rid of it now.

    I'm not sure if its more favourable to have it shown as satisfied though.

    I was thinking the same as Tixy. You could apply for s set aside (£40 I think) on the basis that you never receive the papers. If the company does not respond then you should win by default.

    I think it is more than this unfortunately - around £200? May still be worthwhile depending on what credit they are hoping to apply for in the next 19months.
