You have to complete. Who pays is a separate issue and you can't make one dependent upon the other as you already exchanged. The exchange is the PROMISE and GUARANTEE to buy it. Even if it'd burnt down you'd have to buy it now.0 -
Do you really want the house?
Because with that flood damage and the vendor playing silly beggars, I'd be opening negotiations the vendor abput them being in breach of contract, but for £xxxx consideration you would treat the contract as discharged0 -

I am aware of my obligations to complete. The issues surrounds the seller being in breach, (ie house not in condition it should be - they have removed the carpet) so we need to get to a resolution, otherwise they will be preventing completion.0 -

I would like the house, if we can get to an agreeable conclusion. The damage can be rectified, what we need to understand is how we get there.0 -
So today's update.... a bit of a mixed bag really:
Vendor was at property when we arrived, and have been trying "dry out" the house. they have heaters and will be hiring a de humidifier for the week.
At 12pm I had a damp specialist come to assess the walls and give a view. At the moment he is saying its not a bad as it could be and should dry out fine, but he cannot really say until its dried for a little bit longer (circa a week) he has also recommended the doors, and the skirting boards are replaced as well. He recommends its re tested. If they are required to re-plaster, the cost will be around £2000 (not including doors and skirtings)
The bit that annoyed me the most, was that as I was having my "independent" assessment done. The vendors were there. Which means they basically heard everything (even tho they didn't want to get someone out directly themselves) In some ways my solicitor thinks this is better, as least they know we are not lying but it was still annoying. The EA was then trying to get a copy of the report - which was totally out of order, luckily the guy could see this and has only sent it me directly.
In the end, we had to go up stairs to speak (without being over heard) and even he was surprised to see the vendor there.
Any who, since then, I have had a quote done for new carpets, grippers and kitchen floor £798 but need to sort a quote for the skirtings and internal doors, plus my "rent" whilst I am homeless.
@5.30 my solicitor rings to say that they Vendor now wants to (despite yesterday not doing it) to get some independent quotes over the weekend...
The solicitor will be requesting the funds as "retained" on the condition of the 2nd inspection - for the vendor it means they have to pay it upfront and if its not needed they get it back vs re doing the whole thing and having to delay completion- not sure if they will agree to that though.
So all in all, it wasn't a bad day, but it still not sorted!!0 -
Today is completion day...and another day, another drama. The vendor wanted to do their own quote... apparently...
So have done so but have only included carpets...not sure why as other party was aware of the additional costs. So now my solicitor is sending them all the quotes we've has done to be reviewed. Apparently the person at the house wasn't actually one of the executors. It was just another sister... no wonder she seemed reasonable. everything has to go thru both of the other executors separately so it's taking more time to get sorted....
If it fails to complete today. It is their cost so fingers crossed sense prevails...0 -
How incredibly rubbish for you (and, despite how difficult they seem, your vendor also). I hope this all gets sorted out for you soon.0

... been a long while since an update and we've still not completed.... long story over the past view days with offers changing and mortgage monies being returned etc.
Now after a week of dispute we have a settlement. I'm not 100% this lead to a completion... as we've been here before only for the vendor to change at 11th hour... so fingers crossed....0 -
FWIW, you are incredibly resilient! I would be going mad about it! i"d love to offer some solution but the hest I can come up with it my best hopes for a quick resolution, you sure sound like you deserve it!0

Anyone who may interested... We've finally completed. Just under 10 days since we were supposed to. Today was not without drama. Call from Sols to say it had completed at 10.30. Rang EA to arrange to pick up keys At 2pm. "Sorry we've not been told it's completed, we'll call the solicitors to check... " 4.30 pm finally heard that they had been told. My Sols had said that they have known since 11!!
That aside at least we have the keys!!
