I used to be a O2 broadband user until sky bought O2 broadband. I would like to know can Sky legally charge me £7.50 on top of my normal broadband charge. Sky says the extra £7.50 is for NOT having sky tv and sky phone. Can anyone help

Yes they can.
Think of it this way - the correct charge for Sky BB is £15pm. If you take Sky TV you get a discount of £2.50pm and if you take Sky Talk you get another discount of £5.00pm bringing the cost down to £7.50pm. Just like most providers the more services you have the cheaper the product.
If you phone up and ask for your MAC they will probably offer to keep it at £7.50pm for you. My friend got it for £5pm.0
