My brother-in-law has recently been clocked for speeding in his Motability car.
Mobile speed van caught him doing approx. 35mph in a 30mph zone.
He asks, will the NIP go directly to Motability or himself and is it still a 14 day period for the NIP if sent to him directly.
thanks

It'll go to the name and address on the V5 - does he have the V5?
I believe it is still 14 days. The nip is considered 'served' when it is posted so you could be looking at upto 17 days.
At an indicated 35 he may well be ok ... he'll just have to wait and see if the postman brings anything.0 -
Motability hold the V5 for taxing purposes and paying the lease, only copies are ever issued if required.
He believes his name and address are on the V5, but not entirely sure.0 -
If he doesn't know he'll just have to wait and see I'm afraid. If Motability are on the V5 they will need to inform the police of the drivers details ... it'll take longer for the nip to arrive with your BIL.
Maybe he could ring Motability and enquire who is on the V5.0 -
Thinking about it ... if Motability hold the V5 to tax it, it's likely they're named on it - so the reminder goes to them. I'm only guessing though.0

In addition to the above, if it's his first offence or he hasn't been done for the same thing in the last 3 years, he should be offered a speed awareness course which will avoid the points.PLEASE NOTEMy advice should be used as guidance only. You should always obtain face to face professional advice before taking any action.0

It should go to motability, they will then tell the police the drivers details who will forward another NIP with another 14 days.
Happened to me with a company car from a lease company. Fingers crossed he's ok or can opt for a speed awareness course.
If he does get an option for a speed awareness course let him know to shop around in different towns, I found it a fair bit cheaper in Cheltenham than Oxford.0 -

A NIP is required to be served on (delivered to) the registered keeper within 14 days of the offence, ie. posted and arrived within the 14 days - s.1, Road Traffic Offenders Act 1988.
There is no time limit for NIPs subsequently sent to other people nominated by the registered keeper.0 -

The act says it must be sent within 14 days, nothing about arriving. What goes around - comes around0 -

If he's not had a NIP, how does he know he's been 'clocked' doing 35?0
