Parking Eye Mistake

Hi, sorry if I have posted in the wrong place.
I recived a parking ticket claiming I was parked in a local shopping centre on Christmas eve for 3hr 50mins (50 mins over).
I was never in the car park for anywhere near that amount of time. I made two visits that day, the first time I went to poundland and was in there for around 15 mins then left and drove to a local Tescos. The second time I went back was later in the evening on the hunt for sellotape. The only shop open was Lidle and was only in there for 10mins.
I dont know if they have done this on purpose or there was a camera glitch but the first photo matches up with around the time I went to poundland and the second photo is around the same time I revisited the carpark looking for sellotape.
I am sure if I write to them stating this they are not going to listen. Its kind of my word agaist theirs.
Does anyone have any suggestions about how I should handle this?
Thanks
Jay

I have a photo of the letter but am not allowed to post it as a new user.0

They know you went twice, they are famous for it.
Hence why you ignore the bait and start reading the newbies how to appeal and how to win at POPLA.
Circumstances matter not the POPLA appeal is technical only and not mitigating as they wont believe you as well but will have to allow the technical legal argument and over turn the parking charge.
Now to the top of the forum where it says newbies, read understand, or read again and again and again until you do.I do Contracts, all day every day.0 -
Double-dipping is not an unusual case with ANPR cameras. However this doesn't matter that much in getting this killed off. Simply check out the NEWBIES thread and appeal this as per the template.
If you wish, you can add an additional appeal point ...
x) The PCN is flawed (hence invalid) as it assumes there was a single duration visit. The vehicle attended this site on two separate occasions on the date of this PCN, and neither visit exceeded the allowed stay. Your ANPR cameras have missed the 1st exit and 2nd entry.0 -
Start by reading Newbies Sticky carefully.
This outlines yopur situation and the various options for seeing them-off.
If you base an appeal on the facts entirely, you will almost certainly fail.
Post up your appeal/challenge for further help when you have it together but wait till they send you an NTK before sending it off - you don't want to hand them your details for free or miss the opportunity for them to screw things-up all by themselves.
In the meantime you can complain to the landowner/shops to see if they will get it cancelled.

Pogo - this is Parking Eye and a double-dip scenario. What OP has received is the NtK.

Good advice about contacting the landowners. And if you have a receipt for a reasonable value for either visit then enclose a copy with your appeal to show you were a genuine customer at the site. (PE are one of the few PPCs who will actually cancel if they are provided proof of there being a genuine customer).0 -
Ok thanks for your help. There is so much info here but was unsure if it covered my situation. I will take a closer look at the thread suggested.0

@unixx - can you please confirm that the private parking company pursuing you is actually ParkingEye? Tesco/Lidl isn't normally their stomping ground. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Yeah it is Parking Eye. They manage Borehamwood shopping park. There are many shops in there. Tescos is not part of it, thats just where I drove to after my first visit to poundland.0

OK, thanks. Often new posters use the term 'parking eye' generically to describe other PPCs.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

You dont have a "situation" you have a parking charge.
How or why you got it is now not relevant unless you want to lose the POPLA appeal.
Stick to the plot, appeal with edited template of less than 2000 words to parking eye, get a popla code and make a GPEOL appeal to pola plus the usual guff, it gets over turned and you end up "fining" them £29 + vat.I do Contracts, all day every day.0
