    If the LL is selling, and she is co-operating with viewings, then it is unlikely he will be exchanging for a while, so time is on her side.

    If she is worried about illegal eviction, then it might be worth changing the locks on the door, then changing them back at the end. She would then have to be present for any viewings to open the door if she didn't want them to have a key.

    Part of the Furniture Combo Breaker
    What you need to do(if you haven't already)is write(and get proof of posting)to the agent and landlord stating the date you will be moving out.

    The day after your fixed term expires, you then serve a "Notice To Quit".

    That way, if the landlord precedes with the possession order, you have a reason to ask the judge to not get the costs(£280)of the order against you.

    ok so we need to just send a letter to agent stating our move out date which is 30 march 2015 giving them notice to quit on that date(the new build will be done by then its on final fix now our estimated date of move in from builders is 8 march but we wanted a little leaway in case it goes a week later)

    U serve notice to quit on feb 28th, posted feb 25th, to expire March 30th.

    yes he knows..he knows i asked for advice online..but i have just removed the pic in case of a problem i didnt realise i left his name visible(so in case he sees this i am sorry)

  • well yesterday(13/01)agents now agreed to a new move out date of 30 march which will now be ok,they didnt really want court action either and we are getting a new contract to that time along with the original sec 21 being revoked and a new one being issued to 30 march..
    So many thanks for all who gave advice..

    You can't revoke a Sec 21.

  • ok that was what agent said they have issued a section 21 for march 30th now which is all she needs before other house is done for her to move into..
    yes have looked at your advice as well and will be doing that..
