Sending money to the wrong bank account

Has anyone actually managed to recover money accidentally sent to the wrong account when the recipient does not respond.

My own bank and the recipient's bank, having written to their customer and had no reply, have both said there is nothing more that they can do. The financial regulator tells me there are no procedures in place to cover the situation. The financial ombudsman says the same.

I am told you can go to court to obtain a Norwich Pharmacal Order against the recipient's bank which would force them to provide details of their customer but a quick internet search suggests this is very expensive as you would need to be represented by a lawyer. You would then sue the customer.

............''You would sue the customer...........but there is no guarantee that you would get a penny back even if you won.

You probably have a bank account and therefore probably have recently received new terms and conditions from them starting November/December - one of the new terms is the right of the bank to withdraw funds sent in error without having your authority.
It won't help you in this case but times are a changin'.

There's been a lot of talk about it being impossible to send funds to an invalid account number/sort code combination but I can advise that this isn't always true. I've no reason to doubt that it's usually impossible but as someone who works for an agency bank (the branch of a foreign bank in the UK) I should point out that we regularly get invalid faster payments. By this I mean payments to our sort code with an account number which has never existed in our system.

I also worked for an agency bank, and all account numbers were issued in numeric order, from 00000001, 00000002 onwards. There was no check digit system. So in theory, any number up to 99999999 was a valid account number.

  • I assume if it is an invalid account number you will get the returned fairly easily. I am assuming in my case the account number is invalid but the account holder will not agree to the refund or more likely just does not respond to the banks letters.

Is there really no way around this.

If it was her error, not yours, and if she admitted this like you say, then they must give you a refund and then wait themselves for whatever time it takes to get their money back.
Don't accept £30 bribe and demand what they owe you.

In this case it's a bank error so Barclays have an obligation to return your account to the state it was before the mistake occurred - i.e. by paying you out of one of their sundry accounts - and then they can attempt the money recovery in their own time and at their own expense. They're also liable for any financial loss you incur and a discretionary payment for any distress and inconvenience caused.

Like Grumbler said, if you're sure you supplied the correct details and the cashier admits the error was hers, you should press your case and get your money back as soon as possible. Insist it's logged as a complaint.

Regardless of how strongly you feel about this, you're likely to get a better result out of this situation if you keep calm and rational and focus on facts rather than getting carried away with that sort of stuff!

Next time why not send the money yourself via internet banking?
  • They finished with investigation and want to give me 10+25£ for inconvenience and frustration, I can do nothing in this case, I complained to the Ombudsman and wait as they help me.
