Deposit withheld and extra charges on top!

Hi all,

Without going into too much detail, we have recently moved out of a rented house and have not only been told that we won't be receiving our £500 deposit back, we are also being asked to pay charges of a further £500 for works the landlord claims have been required on our departure - which we are aware haven't actually been done by them- and for things they saying we didn't do when we left, which we did! There's a long list of charges, all made up by the landlord. I have argued the point and intend to continue doing so but wondered what rights a landlord has to do this, how they can do it if the deposit was held in a scheme and what rights we have as former tenants? I feel we are just being ripped off when we have been good tenants for a number of years.

    No. We also were not allowed to stay for the inventory at the end of the tenancy
  • So if there's no inventory, how can he prove the damage? Contact the scheme that's holding your deposit and challenge it.

    Is there any kind of guarantor on the rent ? did they ask for one.
    Did you sign an inventory when you moved in ?
    It matters not if you lost or dont have it, did you sign one.
    Is the deposit protected have you checked the schemes and placed a claim for the deposit to be paid to you.

  • They've said for most of it that they can 'reasonably assume' it was caused by us! It's utter nonsense. I have an idea where our deposit is - although again that's not clear, so I'll give them a try and see what I can do. I've asked for proof off them they have completed the work they claim to have done but he refused saying they have standard charges and therefore proof is irrelevant!

    When we moved in the inventory was just what was in the property, curtain poles/blinds etc, not condition of it. Nothing has been signed regarding the condition. I haven't placed a claim for the deposit, no. I didn't know I was supposed to do this. He basically just said they have withheld it and want the extra money too.

    It is NOT necessary for the work to actually be done for compensation to be due. Forget that angle.

    Concentrate on a) deposit protection and b) standard of, or absence of evidence
