There is no hard evidence that PayPal have taken anyone to court, I would be interested if anyone knows differently.
The debt collectors that eBay have used in the past have been extremely aggressive though and have been fined for overstepping the legal limits.

I would like to thank everyone for their advice / experiences with my problem with paypal.
It would seem that there are many loopholes that paypal should address.
I had a call from them this morning reminding me about my balance and I said again that I would redress the balance as soon as I get my goods back. At the moment, the "buyer" is sitting pretty. They have had the refund and are still holding my goods. I do not even have a definite address as to where my staircase is being held, despite my email requesting same.
As of now, the losers are paypal. Their argument is that they have to abide by their T & C's which seem to give me no rights at all in this case.
The fight goes on, but I would rather avoid court if I can.0 -

The majority of problems/loopholes have already been addressed by PayPal and provided that sellers follow the guidelines for seller protection eligibility, accepting PayPal payments is usually a painless experience.0 -

They won't take anyone to court, they offshored to avoid UK banking legislation and taxation don't forget.

Surely if somone reads up on PayPal seller protection and doesn't want to risk accepting it for a collection only item then they have the choice not to sell it on ebay.0 -

But if they do advertise it on ebay, ebay force them to take paypal.
Ebay/Paypal are well aware of the problems that leads to, but still force it on buyers.

I would like to say that when I contacted the buyer to congratulate them on their winning bid, I asked for cash on collection, but they had already paid by paypal. If they had done what I asked, I would not be in this position, 'cos when they changed their mind about the purchase, ebay resolution centre came down on my side and that would have been the end of the story unless they decided on small claims court action.
Everyone seems to be giving me the same advice though.....sit tight! I'm not bothered about not being able to use paypal again and it wouldn't matter much to my ebay account as I buy more than I sell and can use a c/card for that.

I know it's too late now to help you in this particular instance, but for anyone who may face a similar problem in the future, it is possible to reverse a payment you have made by Paypal. Just go onto the Paypal website and request a reverse.
It happened to me last year when I advertised something on eBay and specified cash on collection. When I contacted the purchaser, they told me they had already made payment by Paypal. I just asked them to reverse the payment, which they did within half an hour, and they paid me cash when they collected the item the following day."There are not enough superlatives in the English language to describe a 'Princess Coronation' locomotive in full cry. They won't take you to court, but they will telephone you *alot* and send many letters saying that they "may" do this and "may" do that, but after a few months they just give up."Love you Dave Brooker! x"
