Caught speeding - first offence

Hi Guys,

Let me clearly state that I am not defending my actions, I know I was speeding.

Ok, so I was on my home on the M3 over the Christmas period and I got stuck behind a lot of cars in the middle lane so I moved into the fast lane and sped up and over took a bunch of cars then moved back in. This last for around 15-25 seconds. (I'm not entirely sure) anyway I moved back into the lane I began in and slowed down to the speed limit again. Before I knew it I was being pulled over by undercover police.

They showed me the footage the recorded of me doing it, like I said literally seconds long and last for 0.6 of a mile.

The average speed I was going during that time was 90mph to which before and after I was doing the speed limit. So I was only doing over the speed limit during the 0.6 of a mile then I was doing the speed limit again before they pulled me over.

They said I had to pay £100 and have 3 points.

What I want to know is, as I have never been in trouble with the law and have no points on my licence which I have had for almost 9 years.

Is there anyway I can fight this? I don't mind the fine, it is the points that are getting me down.

They said I could take it to court as the alternative option but if I lose I would have to pay all the fees etc...

Again, I admit I was speeding and I am aware it was a stupid thing to do even if it was just for 15-25 seconds.

Anyone know if I can challenge this successfully or am I just going to have to chalk it up and have the 3 points?

  • Go to court and plead not guilty.

    You got a fixed penalty, the clue is in the fixed so minimum of three points.

    That's the best deal you'll get.

    Slightly contradictory there.

    Pay up, take the points, will have minimal impact on you as long as you dont get any more.

    If you are "stuck behind them" then overtake them at the speed limit, will take more than 15 seconds but save you more points

    Done the crime, do the time. It's 3 points, who cares?


    It'll have close to zero effect on your life, so just move on. Just don't collect loads more points and you'll be fine.

    You're probably better just taking the 3 points. You can go to the court and plead your case, but there's no guarantee it'll be expected or you'll get the same offer again (likely it'll cost you a lot more).

    You can always check with a solicitor if it's worth contesting it though, as it's always possible, just quite risky.

    To challenge it would require a good reason for speeding. Why accelerate to 90+ to overtake then slow down on a motorway?. If the cars in lane two are driving below the speed limit and need overtaking you can move into lane three and overtake without driving at 90 mph.

    Take the points and fine.

    Hi, think yourself lucky you are being offered to get away with 3 points..... some people have had bans for doing 90+ mph in the past.

    They will have recorded you for 1/2 a mile so i think you have under estimated the speed/distance travelled.

    Or they thought your driving standards were below par and thought give you a speeding ticket rather than one for careless or dangerous driving?

    Well over the legal limit so accept it and be more careful in future.

    And that case would be ....?

    He's admitted speeding, so the only possible plea is guilty.

    A specialist solicitor might find a loophole, but it's extremely unlikely. And he will cost much more than the £100 fine.

    Hi Guys,

    Thanks for all the replies.

    I was asking because I have not been in this situation before and didn't want to take the 3 points so quickly just incase there was a way of fighting the case on the grounds it is my first offence and therefore possibly giving me the option to pay the fine and watch one of their speed awareness videos.

    It's ok, I know I was in the wrong, I just didn't want to later stumble across something online where people are saying if it is your first offence they could possibly offer me an alternative to the 3 points.

    Also to the person who said That I might have the distance that they recorded me at wrong, I am confident that I am correct on that one as they made me watch the whole footage with the distance on it.

    Thanks anyway guys. First offence so just wasn't sure how it all worked. I am a bit of a worry guts but as many said the 3 points will be ok as long as I don't get anymore!
