In September I signed up for 3month trial with gourmet society for £1 I never used the card, then I noticed £39.95 missing from my bank at the beginning of January and gourmet society had taken their yearly subscription money, iv emailed to ask for it back as I don't want to carry on and was unaware this was going to happen after receiving no emails even tho they say they sent some but iv done a search in my inbox and have come up with nothing I also received nothing in the post and don't even have a New card! They are refusing to give me my money back, I'm waiting for a supervisor to ring me Monday to discuss this further. But to help me out they have taken me off any further subscriptions so next year they won't take my money!!! Woop woop! What are my rights? Help please! Iv told them I'm not letting this drop until my money is back in my account!

How did you sign up for the trial?
Its normal for anything like this to automatically roll onto an annual contract at the end of the trial and that should have been in the terms that you agreed to abide by0 -
Signed up through quidco, I understand that's what can happen but if I wish not to carry on with subscription then I should get my money back, plus with no letter sent out to me with my new details on membership, they basically have my money and I have no service?0

It would have been in the terms and conditions when you originally signed up in that if you didn't want
to carry on then you have to contact them and cancel
You may or may not get a refund but check that at the end of the next year that they are not going to take another payment automatically.make the most of it, we are only here for the weekend.
and we will never, ever return.0 -
Cancelling your membership: In order to cancel your membership you must return all property of SL, including but not limited to any membership cards that are valid for a term that has not yet been paid for. Before cancelling your membership you must telephone us on 0845 257 4477, or 0330 223 3784, to obtain a cancellation code, but at least 15 days before your membership term ends. Our property will only be deemed to have been returned to us when we receive it our offices at 63 Lower Hillgate, Stockport, SK1 3AW (for your own peace of mind and avoidance of doubt we strongly advice using a signed for delivery method, such as Royal Mail Special Delivery).
Our Refund Policy and Your Consumer Rights:
13.1 You have the right to cancel your initial term of membership with us within 14 days of joining ("cooling-off period").
13.2 To cancel your membership, you must inform us in writing to our trading address: Gourmet Society, 63 Lower Hillgate, Stockport, SK1 3AW
13.3 If you cancel your membership within the cooling-off period, you will be entitled to a refund of your membership fee. Refunds will be subject to the return of your Gourmet Society Membership Card within 30 days of your cancellation. Subject to any other statutory rights you may have, we do not provide refunds for any cancellations after the cooling-off period has expired.
This us their cancellation policy, they took renewal money on the 6th so I thought I was in the 14day cooling off period but no my 14day cooling off was in September. When I started the trial. They also said I can cancel 15days before it expires which was the 31st December when I got my renewal pack, that I never got! So was unaware of a card I never used in the end expiring. Just so many emails back and forth arguing it's ridiculous. How simple is it to go sorry for inconvienence here's a refund. Doesn't look like that's gonna happen.0 -
You are not alone.
There are many threads on here about the same thing.
Here is just one of them:0 -

Unfortunately this isnt insurance and so there is no automatic legal requirement for them to remind you that the renewal will happen nor any automatic rights to cancel if you forget to stop it before the renewal. What rights you do have are pretty much as per the contract you agreed to when you took out the trial.
The lack of a new card is just an administration issue easily solved by them sending you a new one. If you have a smart phone I believe you can get an "e" version of the card, certainly the free version you used to get with a Barclays account did.0 -

Try it FREE for 2 months, then if you wish to continue you'll pay just £39.95 for a full annual membership - that's £30.00 off RRP

Having a gourmet society membership has enabled us to save a lot of cash on some places we regularly go to.
We received the renewal reminder in time and duly took up the renewal offer.
We are delighted with the service and most importantly the discounts we have received.
Would highly recommend if you want to save a bit of cash on meals out.0 -

A lot of special offer trials have an automatic update to full subscription, if you do not cancel, built into the terms and conditions you agree to when you sign up. For example Amazon prime free months trial is similar, but you ensure that you go into your account and cancel the upgrade if you do not wish to continue. Although you are not entitled to a refund of your membership, you have nothing to loose by admitting that you had not understood the terms and conditions of the offer and very nicely ask if they would as a goodwill gesture cancel the membership and give your money back.0
