Norfolk Parking Enforcement (NPE) or No Parking Ever if you prefer ?

I was unfortunately scammed by these complete thugs lat week. Driving the wrong way into the Earlham House car park. Notwithstanding all the advice I have read on this forum, which is very useful by the way, I have to call into question the reason WHY? this entrance/exit has been re designated to exit only? I have lived in Norwich all my life and have used this car-park on numerous occasions in that time. I see no reason at all why it should be so, in fact as its on a less busy thoroughfare surely it must be safer to do so. I have spoken to the supermarket manager for which this car park largely services and there have been numerous complaints about NPE and on the back of these complaints they are seeking MP's advice to get the practice stopped as it is affecting their business, as people shop elsewhere with no risk of being prosecuted for having dirty hubcaps or any other nonsensical offence they care to dream up. While I was there another guy walked in to complain about the same thing. On leaving I noticed a Tesco home delivery van do exactly what I did. He was impressed when I informed as to the reason I was there. One last thing about this site, the signage looks cheap and tacky. All of the signage around the whole site has been printed on corrugated plastic board and fastened in place with cable ties to any available upright post. The whole operation reeks of amateurism to say the very least. I have mailed my appeal letter based on the one I copied off the forum, with a few tweaks here and there (I left the Love and Kisses bit out) Thanks for the information. Also I would not only be happy about getting this charge quashed, but if there is anything that can be done to get these thugs stopped I'm up for it

    Why did you appeal if the event only happened last week? You should wait for the NTK unless it was a hire/lease vehicle.


    Complaints to shops/landowners need to be backed up in writing and if you get a cancellation that should also always be in writing.


    PPCs can't prosecute anyone for parking on private land, and no offence has occurred.

    This isn't even anything to do with Parking.

    If you'd have waited for the Notice to Keeper, you could have fired off a complaint to the DVLA that NPE had obtained your data unlawfully, as their KADOE contract only covers parking events. But that avenue's gone.

    Still, the PoFA won't apply so if you get any paperwork that says it does, then you should complain to the BPA and DVLA.

    Because he would have received a fake 'postal PCN' (i.e. no windscreen ticket, no ANPR, no audit trail. Not allowed and no 'parking event' anyway!).

    Ah! In that case, a complaint to the DVLA IS in order, NPE will have obtained RK data outwith the provisions of their KADOE agreement, as this is nothing to do with parking.

    I know they try and dress this up as Trespass, but I'd argue the toss that it isn't.

    Regardless, all the old 'Sum doesn't represent any actual damages' arguments still apply.

    I had the NTK through yesterday, I didnt know anything about the alleged "offence" until then as no ticket was issued at the time. All so called evidence was obtained by CCTV camera.

    Yep we know, so you were right to appeal now. Your POPLA appeal needs to cover the fact this was not a parking event and the fact the PCN breaches the audit trail requirement of the DVLA KADOE contract for releasing data. This won't be the winning point at POPLA though so you will need to look at the Park Direct (a different PPC) examples of a POPLA appeal which are similarly worded and make sure all the usual winning words are also used (about no GPEOL etc).

    Doesn't matter anyway, the KADOE contract expressly provides for collecting unpaid parking charges only, it's not for pursuing damages for random, non-parking-related torts.

    Same with Schedule 4 - it's about parking. So a keeper can't be held liable for this rubbish and the DVLA should NOT be giving out data.
