Anpr pcn

Hi,
I recently got a PCN from ANPR Ltd. handed to a passenger of my car, for overstaying the alleged 3 hour limit by 14 minutes. :mad:The car had a properly displayed Blue Badge, although there were no available disabled spaces, so the car was parked in a normal bay. This meant I never went to the P&D point or noticed any signage.
Do I appeal now as the 14 days are up within a week. Or do I wait for the NTK.
Any help would be greatly appreciated.:):):)

    As a bit more info. I was pushing my mother in a wheelchair, then another disabled passenger of the car, noticed a man (not in a uniform) writing something. At first I thought he was some kind of car twitcher, until he gave my other passenger the PCN.

    bear in mind this "properly displayed blue badge" has no relevance to private land , but the EQUALITY ACT 2010 does (although popla never take it into account)

    stick to the NEWBIES thread for now and use the legal arguments to beat clever trev at popla, if he is daft enough to take it further

    The thing is with ANPR Ltd, I strongly believe they are about to be kicked out of the BPA. Check out their (new/changed in 2015!) website. 'We always ignore emails' they say proudly, and have a cartoon picture of Milhouse from the Simpsons. Also a case I have just helped with which was still within 28 days of the NTK, had the PCN set at £140 in flagrant disregard for the BPA ceiling. So I think they are about to part company.

    The good thing for you is maybe that will happen BEFORE the 28 days is up, in which case they will never be able to get your DVLA data and cannot write to you AT ALL (unless the IPC let them in as AOS members but I can't see it straight away).

    So definitely sit tight! Do not even complain to the BPA yet about the lack of email appeal provision; say nothing to anyone yet. How much is the PCN amount?

  • Sorry for not getting back sooner, but still waiting for NTK.
    Initial PCN demand was £50 and £100 if not paid within 14 days.

    But lets hope he cannot be bothered chasing this up.:D

    He wouldn't like to see what I charge in fees:eek:
  • What ANPR say about emails is:

    "Your personal details at some stage may be held on our servers! We therefore take every step to protect them from misuse or abuse. For this reason alone we will not open emails, we do not reply to emails and we always ignore emails. Using Royal mail may have a cost but it's only pennies, it may be inconvenient and slower, but its more reliable and it will never give either of us a nasty virus."

    What this probably means is:

    "We cannot work out how to open emails to read them, let alone find the reply button. And we have absolutely no idea what anti-virus means - is it something you get from the doctor?"

    It does make you wonder why any other organisation has ever considered using email to communicate, given that it is obviously so dangerous...

    complain to the BPA, give them a copy of this outstanding notice and say its the first you have heard about it as RK, you have not received any other postal paperwork etc

    ask the BPA why ANPR have not sent you any official paperwork prior to this collection notice

    then let the BPA investigate ANPR

    dont mention any windscreen ticket etc at this moment in time

    in other words , treat this as the NTK , complain to the BPA and send the template letter to ANPR as well (treating it as the first NTK)

    All in the NEWBIES sticky - initial appeal as per template (post #1), get rejection from ANPR Ltd (with POPLA code), draft your appeal to POPLA (post #3), flash it here for a quick review from regulars, send it off to POPLA, have it upheld, cost owd Trev 27 notes, get on with the rest of your life.

    PS - congratulations on receiving recognition of your OUTSTANDING PARKING! :)

    Why not put on your letter to the BPA a small question along the lines 'Are you aware of ANPR Ltd doing this on repeated occasions or is this a one-off incidence?'

    I'd love to see the answer!
