    Hey, I thought that I had explained that. The letter refusing me PIP dated April 14 also had on it that they (the DWP) were looking at another similar benefit instead, similar to PIP (Attendance Benefit) and using the PIP claim form as an application for that benefit.
    I wrote in April 14, as I have said, and then waited for the result of the Attendance Benefit review. That was decided in December 2014 as a fail also. I assumed it was all lumped as one. However when I received the decision in December 14, I contacted the DWP as I wanted to appeal against the PIP decision (April 14) and the Attendance decision (December 14). It was then that I was told that I could no longer appeal against the PIP decision but could appeal the Attendance one. That was no good as I had a motability car which had been taken back in April 14 and needed it back. Attendance wouldn't give me a car.

    Hey, yes I know that, but the DWP always say that it is a waste of money going recorded. I relied on the fact that when the DWP post something and they record that in their records, delivery is to be assumed within 48 hours. I've been down that road before with them.


    So what you are saying is that posting proof will NOT be accepted as proof by the DWP? Yet we have to accept that delivery has taken place if the DWP say it was posted by them irrespective of whether we got it or not?

    In an earlier thread post you said you didn't appeal or anything....but you're now saying you wrote a letter ?

    Hey, that's right, I did not appeal, never have done, still haven't - there is no point unless I can convince them that I was going to when they eventually got back to me with the Attendance decision. I did write a letter but it certainly couldn't be said to be an appeal. I simply acknowledged their letter which (a) refused PIP and (b) told me that they are looking into another similar benefit for me.

    Then perhaps you should have appealed at the time rather than now trying it on over half a year later.

    Hey, all I want to do is (a) get the DWP to find that letter - they don't actually believe it ever existed! and (b) see if there is any leverage in it to get them to allow a late appeal.
    It does seem strange but going from High mobility and Middle care to nothing doesn't seem right to me either. I know where I went wrong with the PIP form, I expected the DWP to contact the people I had put down who could vouch for my problems. I filled very little of the form in and the DWP did not contact anybody on the list. Where I went wrong was to allow the DWP to look at the Attendance Benefit instead of appealing the PIP decision.
    I don't mind being judged and I'll be the first to admit that I have truly cocked up. It has cost me the motability car, the benefit payments along with the loss of the Pension Credit and no more help with the mortgage interest. A very expensive error.
    I'm just trying to find a way out of it.

    The point you are missing is the PIP and AA decisions were exclusive of each other. You obviously thought you would be entitled to PIP hence why you were "shocked" when it transpired you failed the assessment AT THE STAGE you should have appealed as in your eyes they were denying you something that you felt you were entitled to!

    God some people are always so full of excuses and more focused on deflecting the blame. You wrote a one page nonsense letter and are now trying to exploit your proof of postage receipt into getting something you are not entitled to anymore i.e the right to appeal

    Ok, you have admitted that you 'cocked up' by not appealing the PIP decision, this resulted in a loss of your car, pension credit , council tax? and mortgage help.

    You have now said you have been notified in December, (not sure what date) that you will not receive Attendance Allowance either, why have you not appealed this decision? I believe you have a month to do this one too.

    If you did appeal this December decision, and won, it would not give you your car back but it may give you pension credit, council tax help and possibly carers allowance I believe? I think you really need to move on from the loss of your car, it aint coming back baby.

    I would hate to see you posting in six months time that you didn't appeal this Attendance Allowance refusal decision and wondering what you could do about it then.
