Proof of posting - DWP

racon
Hey everyone. I had the PIP decision in April 14 - failed. I didn't ask for a review of the decision or put any appeal in. I decided a month ago to see if they would accept a late appeal/MR. Just had the reply - they won't as I could give no good reason why it was late. I was 65 in June 13.
Does anybody know if the DWP have to accept that 'Proof of Posting' means that correspondence must have been sent and that the DWP must have lost it?

Are you intimating that you are considering going down the route of telling them that you did ask for a Mandatory Reconsideration within the timescale allowed and that they didn't receive it?0 -

If I actually wanted to do that, how on earth could I now get a proof of posting for something that was never posted back in April 14? I would have had to have posted something at the time and have the proof of posting with me. You can't backdate a proof of posting slip can you?
I do have a proof of posting slip dating back to April 14 for an envelope that was sent to the DWP. I just want to know would the DWP accept proof of posting as confirmation that something was posted but is now lost by them?0 -
You have lost me.
As a former DWP employee who at one time worked in post routing if an envelope was received it was opened (unless marked confidential for a named employee) and a general note put on the system of what had been received...i.e MR, Change of Circs etc etc.
Call them and ask them to look at your screen notes of what was received by them in April is possibly
the best answer??0 -

"Marleyboy you are a legend!"
MarleyBoy "You are the Greatest"
Marleyboy You Are A Legend!
Marleyboy speaks sense
marleyboy (total legend)
Marleyboy - You are, indeed, a legend.0 -
Hey, no I am not. What you are suggesting is illegal!

Perhaps by hoping to claim an envelope that you did post in April '14 with a 'proof of posting receipt' was in fact your Appeal.... I would have had to have posted something at the time and have the proof of posting with me. You can't backdate a proof of posting slip can you?
See above......I do have a proof of posting slip dating back to April 14 for an envelope that was sent to the DWP. I just want to know would the DWP accept proof of posting as confirmation that something was posted but is now lost by them?
...and it's clear what your intentions are.0 -
Was exactly the same when I did post duties in tax office - only in those days it was put in a special folder & delivered to named person by post clerk. Everything was date stamps too!0

So you have a proof of postage for something that was sent to DWP but you don't know what it contained - or you do know - but hope they might be persuaded that it was an appeal.0

Now the DWP state that they cannot find that letter which although I accept it isn't a formal appeal as such, it does show that the intention to appeal was there.
Eventually when the Attendance decision came through (December 14) as a fail I asked about appealing the PIP decision. That was when I was told that I was well out of time and could no longer appeal.
I just need to prove that the intention was there in the beginning. hence I need to prove that the letter was sent but lost by them.0 -
if you had an intention to appeal why didn't you do so within the timeframe?
Unless you can provide a good (and valid) reason as to why then you are too late.0 -
Proof of posting is just that - evidence that you posted an item. It doesn't mean that it actually arrived at the DWP or that they lost it. For that you would have needed to send the item Recorded Delivery.
I really don't think you have any realistic chance of getting appeal accepted now.0
