Currys messing us about.

Hello.
We received a TV for christmas from my parents but we were unhappy with the quality of the picture. We took in to our currys/pcworld store and was told it would have to go for repair. We had the tv for a day and they said it needed repairing? Also, my mum told me that they had deferred the guarantee until the 25th of December just incase we wanted to exchange. We were told instore that that guarantee was null and void as soon as we opened the tv. How was we supposed to know if the tv was any good just by looking at an unopened box? They said that the tv was bought on the 18th of november so the 21 day money back guarantee has elapsed.
Surely these guys are breaking the sale of goods act? Are we not entitled to at least store credit so we can get another telly? We fear that we are stuck with this telly now. Help!

Did your parents get a gift receipt when buying the TV, and give that to you? Or did they just give you the receipt? (or do you not have any receipt?)

Strictly speaking your parents have the rights as they purchased the TV.
Having said that, if they were dealing with the buyer then yes they are going against the terms of the SOGA. You have a reasonable period after purchase to inspect and if necessary reject the item for a full refund. Although this period isn't defined it would be entirely reasonable for a gift purchased as a Xmas present not to be in the position to be fully inspected until after it was given to the recipient.
What is the state of play at the moment, have they taken it away for repair? Did they know you weren't the buyer?0 -

My parents have the receipt. They bought the telly from the Rugby branch. I live in Barnsley so we took the tv to the Rotherham branch. My parents had spoken to the manager of the Rugby branch and he said to take it to the rotherham branch and they would make arrangements there and the information was put on the main system so receipt would not be necessary. When after rotherham branch took the telly for repair instead of offering any options, my mum went back to the rugby branch where the manager was confused and said that he would have replaced or issued a credit note for the telly. My mum received a dispute number . She then phoned the customer support centre who read the script and told her what we were told. Hope that makes sense.0 -

Yes, they were aware that we were not the buyer. They said that i would be contacted in 21 days (convenient?) regarding whether it was fixed or not. I find the whole thing utterly ridiculous.0 -
Currys money back guarantee is if you get a product you don't want you can return it for a full money back refund if you don't open the box (so they can resell it)
You've basically opened the box, watched the TV and decided the picture is rubbish so want your money back. This wouldn't be covered by their money back guarantee policy.0 -

But how was we to know this without opening and viewing? We have to inspect the telly surely?0 -

because the money back guarantee is for unwanted goods, not for faulty ones.
for faulty goods you use the SOGA
Guarantees and warranties are extra to your normal rights, not instead of, and can have any terms they like in them0 -

Yes I agree and you are covered under SOGA. You are just not covered under their instore guarantee policy.
A lot of companies don't allow change of mind refunds on instore purchase so the currys one is actually quite good. It's just unfortunate that it only works for items that you know before opening that you don't want!0 -
Ok thanks so are our hands tied then until they ring us about repair? and if so, can we then use SOGA and ask for store credit? I'm not after a refund, just a different tv, i'm even willing to pay more to get it.0

What happened with the dispute code? have you contacted them again and asked the question re: replacement (and paying more if necessary)?0
