NTC - Fine ticket dispite clearly displaying a valid ticket

Firstly I am sorry if this is the incorrect place to post I have read this forum a lot.

I have followed it before and won! so I know it works but this time it is different and I would really appreciate your advice.

I parked my car and paid for a ticket. I clearly displayed it but yet on my return I had a 'Norwich Traffic Control' Ticket fine on my side window. I took photos which show my ticket clearly on display and I have my valid ticket.

Should I appeal with this information or use the standard template regardless?

    I don't see anything different here.

    What actually happened means very little to these guys and if you try to base an "appeal" on it, you will almost certainly fail - stick to the advice in the Newbies sticky but you could include a scan of the ticket/image along with the rest of the challenge to see what happens - you may be the exception that proves the rule! :)

    Whether it does or not, if you go in front of a judge and swear to it he/she will invariably believe you, even if PoPLA think otherwise. Jump though the hoops if you wish, but in a CC, a PPC has very little credibility..
    You never know how far you can go until you go too far.

    I disagree with The Deep on this one. All depends on the judge and most will have already made up their mind before the hearing starts.

    Pretty much all judges today blindly quote ParkingEye v Beavis without really understanding if it applies or not, and if it does apply, without understanding that it goes against all previous case law.

    While some judges will find any excuse to rule against the parking company, others will find any excuse to rule for them. it is a complete lottery.

    Best to get this knocked on the head at POPLA.

    But the difference between this and Beavis is that Beavis did not pay, OP paid,, (and can prove it). No initial loss, no breach of contract, no reason to invoice OP.

    I disagree that CCJs are maverick. I have only been in front of three, but they were all fair and reasonable.
    You never know how far you can go until you go too far.

    Use the template, but your initial point should be that you paid for a ticket which was clearly displayed in your window.

    Consider appealing on day 21, or waiting for the notice to keeper, for reasons stated in the newbie thread. Appeal as the registered keeper.

    Edit your posts to remove information about the driver.

    Do not send them your photos - save these for POPLA.

    However, you can ask them for their photos. Consider doing this now, separately from any appeal.

    Dear BPA,
    I wish to complain about NTK who issued my car a ticket despite a valid parking ticket being in the window. I enclose my photographs. Please do not forward these to NTK but instead ask them for their photographs of the incident. I believe this will establish they are acting fraudulently.

    The Deep isn't talking about going in front of a judge to plead no contract, no GPEOL or any of the other usual legalese, he's talking about going in front of a judge to plead, in effect, "I bought a ticket, I displayed it, now who wants to call me a liar?"

  • The cynic in me was wondering when this would start.

    IPC deny all appeals so why not ticket even those that have paid?
