    If you're looking for an urgent solution to your problems, issuing a Letter Before Action might be the best shout.

    From what it sounds like, you've attempted to mediate with both CPW and Samsung, and the situation has reached somewhat of a deadlock.

    Do you have it in writing that CPW admit to breaking the seal when they first attempted to repair the item, thereby voiding the warranty?

    Whilst I think that the Ombudsman route may well be a valid route, you'll be waiting a minimum of 8 weeks to hear anything (from personal experience). At least with a Letter Before Action, and then a small claims court filing you'll get the ball rolling faster.

    You could sue. It sounds like you can prove the repair dates and it would come down to who the judge believes as far as any interim repair elsewhere is concerned. It only requires more than 50% in your favour as far as the case is concerned and it is quite likely CPW would settle before it got to court. However, it's not watertight and not cost free unless you win. It would be worth sending a convincing Letter Before Legal Proceedings with a deadline for them to agree to repair or replace the tablet properly and a statement of the action and claim you will make if they don't. There's no cost to that stage and you don't have to follow it through if they do nothing.

    You should address it to CPW head office with that heading. There is guidance on the wording. You could look at:-

    I have isssued LBA's a few times and achieved the desired result (albeit with an airtight case) and my friends have got as far as suing more than once - again, they never got to court and won.
  • Thanks guys .... yes I do have repair details but nothing in writing to say they broke the seals ... they are saying they didnt break the seals and this is the issue. I will definitely look at writing those letters - I think I need to take a couple of days off over the christmas period or it will ruin my christmas with my family as I am so stressed about it ... will return to battle after boxing day ... and thanks again for that advise :D
