Is the estate agent being unreasonable?

  • To put it bluntly, the estate agent is taking the proverbial.
    Any half decent solicitor would advise to take another look before signing the contracts as that is the condition you are buying it in, not when you viewed it.

    Quietest time of the year for all estate agents too. Prob wants to sit on his/her !!!! all day in the office
  • Just playing devil's advocate here, but do you have any flexibility? You and your girlfriend don't both need to be at the viewing, is there any way one of you could do it at 9am or 4.30pm or something? Most employers have some flexibility for one-off appointments, you shouldn't need to take a whole day's annual leave for it.

    I do get your point though, I'd be annoyed at having to rearrange my work because the EA can't fit you in during their advertising times.

    She does have to be there in my view as she has only seen the property once and that was over a month ago. She wants to see it in the flesh again which I don't think is too much too ask really.

    Re: Flexibility, I can be reasonably flexible but she can't unfortunately as we both work on the opposite edges of town and I'm the only one that drives. She gets about mostly on public transport so its a push for her to get to a 6:00pm appointment at times.

    Like I said, the only appointment we have been offered was next Monday at 12:30pm which is fine for me as i'm off from tomorrow until 5th Jan, however she is still in work.

    Looks like I might have to start pulling out a few of your suggestions such as the "not completing without another viewing".
    They close tomorrow so would ideally like to get something booked in before they close - I may drop my solicitor a line and ask for her advice or what she recommends.

    Ive asked for a Saturday as that is pretty much the only time me and my gf can do as we both work till 5:30pm Mon-Fri and can't afford to take holidays for the sake of an 30 minute viewing.

    Surely its not necessary to take a whole day off work? Can't be that important to view the property either if that much of an issue for you.
  • Well having to take any time off is going to be a nuisance really when they can quite easily fit us in on a weekend but are choosing not to.

    You don't have to take any time off if you have a viewing in the next two weeks.


    If I was spending hundreds of thousands of pounds I think I might think one day's holiday was a small price to pay to check I was happy with what I was spending it on. Each to their own though.

    I wonder if the vendors don't want to be invaded on a weekend -or if the estate agent has a policy to keep buyer and seller apart.

    I too would consider it a worthwhile use of a days holiday though.

    I know they don't. I'm working every day but the OP is off until the 5th. My suggestion was that their OH should make time for a viewing by using holiday.
  • I think you should always go back and take a look at point of exchange as the vendor has the responsibility to ensure it's in the same state from the point of exchange to completion. Being an empty house this is all the more important as what if a ceiling fell down?! Dramatic I know but if that did happen before exchange the vendor could argue it was like that at exchange so tough luck, it's now your problem. If you view it near excahnge you can say well no, I know it wasn't like that and that must have happened since so it's your problem.

    I think EA's are clearly saying you're not worth their time as they've got the sale, but don't accept it. We managed to get the extra viewing after work as one of the EA's lived near the house and let us in on his way home for 20 minutes (also an empty property - we never met the vendors).

    I agree with the OP. just thought I would add this as so many people are saying they think the OP should be making all the effort here.

    IMO a further viewing at this late stage is not a necessity, I would not be bothering, esp as you've had the usual two viewings already, but if you ask for it you should be allowed it. It's not that much inconvenience for the agent, surely?!

    And before anyone jumps on me saying its a big purchase and why shouldn't you view as many times as you like, well that is of course true, but that is the norm generally speaking. Measuring for curtains and all that stuff is not a necessity. Does anyone really actually go out and buy new curtains and have them altered to exactly fit the windows, ready to be put up on moving day?!? But if you want to look for whatever reason, you should.

    I see no difference between them working extra time to accomodate you, then your OH taking time off to accomodate your wishes.

    Everything that you wish to do can be done by yourself without the OH's presence.
