Could any of you please advise on this case? I could not find information applying to this case in the Newbie threads or others.
I was issued with an invoice for £55 from a car club - private car leasing company - in response to a parking charge notice (PCN) from Highview PPC.
The issue is: the car club have already paid the money to Highview PPC in response to the PCN. The car club paid the money to the PPC before telling me anything about it.
Do you advise appealing against the PCN now that the PPC have already got the money?
Any advice would be most helpful, thanks!

clearly the lease company didnt follow the BVRLA 2014 guidelines of naming the driver0 -
As registered Keeper they are legally responsible for the charge.
If they have paid it and have helped themselves to your money I would start a charge-back, if they did not want to stump up the parking charge they should have read the paperwork and filled in the drivers details.I do Contracts, all day every day.0 -
correct, if they wanted to deal with it as RK then they should have appealed it, or named the driver
you are not responsible for their ignorance and they chose to pay it, not you, so they cannot charge you as I doubt the lease mentions anything about private invoices, only fines or penalties, which this isnt
so maybe they should read the BVRLA guidelines more often (I think it was jan 2014 when they were issued)0 -
Post up the part of your contract with the car club which details how they will handle parking charges. All depends on this.
If you did not agree to pay all parking charges then you should be able to get you money back. How did they get it from you? Credit card? direct debit?Dedicated to driving up standards in parking0 -
Has the car club taken this money from you, or are they asking for it now?
Check the terms of your lease with Car Club carefully. What exactly does it say about recharging you for such things? And when I say exactly, I mean what are the exact words it uses? No paraphrasing, or rewording in your own way. This is important in ensuring that they have acted in contravention of their own terms.0 -
The main Issue is, Dodgy parking crooks will just ticket any car club car they see driving about.
If they just pay up without even contacting the driver a more perfect quick buck scenario could not exist for the parking firms.
Have they forgotten they are dealing with ex clamper, knuckle dragger's and convicted villains.I do Contracts, all day every day.0 -

I have checked the Terms & Conditions of the car leasing company. They are available to read in full on the City Car Club website, with link to 'terms and conditions' at the bottom of their homepage (as a Newbie I am not allowed to post the direct link, sorry).
Relevant sections are 9 and 10, including:
9.4 The Member’s signature to this Agreement, or online acceptance of City Car Club’s terms and conditions, shall constitute authority for City Car Club to compute and debit all monies due against the Member’s nominated credit/debit card or bank account at any time. This includes charges due as a result of theft of, or damage to, the Vehicle, including any fines, administration charges or court costs for parking and traffic offences as described in section 10, plus any penalties or any other costs arising due to the Member’s use of the Vehicle.
Section 10 includes:
c) Any applicable penalty charges;
e) Any fines, penalties, court costs or other expenses imposed on City Car Club by law arising from the use of the vehicle while on hire to you, unless due to the City Car Club’s fault, which shall not relieve you or any other person of direct responsibility to any public authority for your unlawfulness;
City Car Club have applied the £55 charge to my account, plus their own £25 'administration' charge, and claimed these funds from my bank (which I only just learned of).
I intend to 'query' this at the very least.
9.6 All invoice queries must be raised within 14 days from date of invoice.
Once again, any advice would be much appreciated, especially if you have insight into the wording of the Ts & Cs.0 -
