You could also, in your letter to the Hospital Trust, copy them the link to Fergie76 thread here, suggesting that you might be forced to follow a similar line unless this is resolved to your entire satisfaction.

If they do have "a panel" to review appeals, which I am 99% sure is a lie, you would hope that at least one of them would steer the decision in a direction compliant with the law!0

It seems with the introduction of the IPC, the BPA has lost ALL control of its members. I think this needs gathering together and being presented to the Transport Secretary and the DVLA etc.
Even though they admitted receiving your appeal, they feel they can ignore the BPA CoP without sanction.0 -
BPA PPC's have the BPA by the balls.
If they BPA p!ss them off or ban them, they just jump straight over to the rogue IPC.
If the BPA bans a PPC and they jump ship straight to IPC, do they automatically get DVLA access back or would they need to serve a probation period?0 -

While I agree with the actions, i.e.
- Complain to the Trust
- Complain to BPA Ltd
- Complain to DVLA
as the scumbag PPC is deliberately flouting the Code of Practice, that DOES NOT mean that PoFA does not apply. the Act itself says nothing about an independent appeals service. That was purely a condition set by the Secretary of State for POFA to be enacted. So don't say "POFA doesn't apply" (though it probably doesn't because of non-compliant notices or missed timescales).
But DO follow up all those complaints, else they'll just keep getting away with their lies.0
