  • Mine was opened in the 90s.

    They sent me a response that said we don't have the agreement, but you would have signed one and we enclose a copy of a current one.

    Standard reply from Littewoods trying hide the fact that they don't have a copy, and in fact as said may never have had one. They are completely wrong.

    I didn't expect to receive anything other than a signed a copy of a credit agreement from them.
    With it being from so ling ago I can't actually remember if I signed anything but I think its highly unlikely I did as I am forever putting things in a drawer to deal with later and forgetting.
    Do you think this means that they have not got a signed credit agreement?
    What if I applied online and ticked a box, what would that mean?
    It's awful when you can't recall something.

    Very likely. They are screwed and they know it which is why they are trying this con job on you.

    It dosent matter if you signed an agreement or not, to make an agreement legally binding, they have to have a signed agreement, from that time period, otherwise they cant enforce it.
    So if they cant produce what they are supposed to produce, they are stuffed.
    Respond to them as you have been advised, that is the way forward.

    Capquest own it.

    Had a few solicitors letters from drydens Fairfax, one stated if you don't pay we have nene instructed to issue court proceedings. A copy of the letter and accusations of misleading me to believe they could enforce after failing to provide a CCA saw the back of them.

    Obviously I have defaulted on this now, although the latest letter to accompany the unsigned credit agreement says if I don't pay outstanding amount they will issue a default notice - confusing!
    So what are the long term implications on my credit file. Does it make a difference I have no signed credit agreement?
  • What's the account show on your credit report?

    If defaulted, falls off your report 6 years from default date.

    If not, what does it say?
